Wastewater and Water Infrastructure Systems and Associated Equipment and Services Bids will have the date and time stamped upon receipt. Bidder is solely responsible for the timely delivery of the Bid and no Bids shall be considered that are presented after the public call for receiving bids. Bids received after the date and time specified will be returned, unopened to the bidder, if requested in writing. The Authority will send a bid packet, upon request, through private courier service to such Bidders, but the Authority relinquishes any responsibility to insure that bid packets are received by Bidders. The Authority assumes responsibility only for sending the Bid packets to the courier service and not for proper and timely delivery of such packets. The cost of sending the packets shall be the sole responsibility of the Bidder. Each bid must be accompanied by a consent of surety and a bid bond, cashier's check or certified check for not less than ten (10%) percent of the amount for the bid, not to exceed $20,000.00 maximum, whichever is lower. Certified checks shall be made payable to the Jersey City Municipal Utilities Authority. The surety shall be bound to furnish a performance bond in an amount equal to one hundred (100 %) percent of the contract price. BIDDERS MUST COMPLY WITH THE REQUIREMENT ON THE NEW JERSEY PREVAILING WAGE ACT, N.J.S.A. 34:11-56.25 ET SEQ., AND REGULATIONS WITH RESPECT TO CONDITIONS OF EMPLOYMENT TO BE OBSERVED AND MINIMUM WAGE RATES TO BE PAID. BIDDERS MUST COMPLY WITH THE REQUIREMENTS OF N.J.S.A. 10:5-31 ET SEQ. AND N.J.A.C. 17:27-1.1 ET SEQ. AFFIRMATIVE ACTION OF THE STATE OF NEW JERSEY. Accompanying the bid of corporation, partnership, or a limited liability company, there shall be submitted a statement setting forth the name and address of all stockholders in the corporation, partnership or limited liability company who own 10% or more of its stock, of any class; or of all individual partners in the partnership or members in the limited liability company who own a 10% or greater interest therein, as the case may be. If one or more such stockholder(s) or partner(s) is itself a corporation or partnership the stockholders holding 10% or more of that corporation's stock, or the individual partners owning a 10% or greater interest in that partnership, as the case may be, shall also be listed. The disclosure shall be continued until names and addresses of every non-corporate stockholder and individual partner exceeding the 10% ownership criteria established in the applicable New Jersey Public Laws of 1977, Chapter 8, has been listed. The requirements of N.J.S.A. 52:25-24.2 are to apply to all forms of corporations, and partnerships, including limited partnerships, limited liability corporations, limited liability partnerships, and subchapter S corporations. The Authority reserves the right to reject any or all bids, to waive any informalities, or to accept the bid for the contract that, in its sole judgment, best serves the interests of the Authority, in accordance with applicable law. The bidder's bid shall hold firm for sixty (60) days. Mutually agreed upon extensions of time may be made, if necessary, and in accordance with law. No bids shall be withdrawn for a period of sixty (60) days subsequent to the opening of bids without the written consent of The Jersey City Municipal Utilities Authority.
