The conditions for the bid are as follows: 1) The scope of work includes: Installing a trenchless point repair in a 4" sewer lateral approximately 1 ' behind the sidewalk cleanout at 300 N Queen St. The point repair is needed to provide a smoother flow channel through the lateral due to a 14" offset connection behind the cleanout. The sewer lateral is at a depth of approximately 11 ' within the sidewalk. 2) The contractor shall provide: All labor, equipment, and materials necessary to complete the work stated in the scope. This shall include but not be limited to all safety equipment, atmospheric monitoring, work zone set up, and work zone tear down. The contractor shall be responsible for coordinating with all responsible agencies regarding traffic control, utility line locations, easements, etc. 3) The City of Kinston will not be responsible for work zone set up, work zone tear down, or any wastewater bypassing to complete the trenchless point repair. The contractor shall maintain valid insurance as follows: Workers Compensation providing statutory limits and Employer's liability limits of not less than $500,000.00; General Liability and Vehicle/Equipment Liability with limits not less than $2,000,000.00 per occurrence covering bodily injury and property damage. The City of Kinston will need to be named as additional insured and the certificate holder on the COL 4) 5) The Contractor hereby agrees to indemnify and hold the City harmless from and against any and all loss, cost, damage, suit, liability, claim, settlement cost, or expense, for loss of, or damage to, property, including Contractor's or City's employees, incidental to the work performed under this contract. The Contractor shall, at the City's option, defend the City at the Contractor's sole expense in any litigation involving the same, regardless of whether such work is performed by Contractor, its employees, or by its subcontractors, their employees, or any or all of them, provided that such indemnification and hold harmless. This shall not apply to claims for loss, damage, injury, or death caused solely by negligence of the City. 6) The City of Kinston reserves the right to remove some or all of the items listed in the scope of work before awarding bid. Work will be awarded to the lowest responsive bidder based on total bid amount. The total bid amount can be submitted for payment, and will be payable as a one-time lump sum payment upon approved inspection of repair. Additional repairs may be added to the scope of work upon agreement between the City and the Contractor, up to 100% of the original bid. Any change order requested shall be submitted in writing and approved by the owner before any additional work not stated in the scope is performed.
