Renovation of a recreation facility in Saginaw, Texas. Completed plans call for the renovation of a recreation facility.
The City of Saginaw is accepting sealed bids for the purchase and installation of a 200 KW Generator at the Recreation Center (hereinafter the "Project") on the Property (hereinafter described). These bid specifications set forth certain instructions, terms, and conditions that apply to the Project. A bidder submitting a bid on the Project will certify by signing the attached Bid Proposal Form that the bidder has read the provisions contained herein and that the bidder agrees that the provisions will be strictly enforced in all respects Project Description. The City of Saginaw desires the proposal for the purchase and installation of a Generator. Below are the Scope of Work Additions, Exclusions, and Clarifications: o Furnish and install a 200KW Kohler Diesel Powered Generator with an 800A Main breaker 3PH 120/208V ("Generator"). o Furnish and install a new 1600A Service Entrance rated Automatic Transfer Switch per NEC Code. o Remove the existing Feeder conduit running from the utility transformer to the existing building MDP. o Shut power down to the Recreation Center and intercept the existing conduits to Page 3 turn them into the new Automatic Transfer Switch. o Pull in new wires from the Automatic Transfer Switch to the existing utility transformer and restore power to the Recreation Center. Power to the Recreation Center should be off for an estimated period of 24-48 hours depending on an agreement with Oncor. o Install conduit and wire for 800A from the new generator to the new Automatic Transfer Switch. o Install a new concrete pad for placement of the Automatic Transfer Switch. o Install a new concrete pad for placement of the generator. o Fill the tank with 416 gallons of diesel for startup and testing. Evaluation and Bid Award. After the deadline for bids, City staff will review and evaluate the received bids and make recommendations to the City Council. Bidders whose bids will not be recommended by City staff for consideration for a bid award will be notified as soon as possible of that evaluation result. In order for a bid to be awarded, City Council must officially award the bid. The City, in its sole discretion, may elect not to accept any bid, and may reject any and all bids. The bidder submitting the awarded bid may be referred to hereafter as the "Contractor." 3.05 Lowest Responsible Bidder. The City Council will evaluate proposals using the best value method. The contract may be awarded to the lowest responsible bidder or to the bidder who provides the goods or services at the best value to the City. In determining the best value for the City, the City Council may consider the following: A. The purchase price; B. The reputation of the bidder and of the bidder's goods or services; C. The quality of the bidder's goods or services; D. The extent to which the goods or services meet the City's needs; E. The bidder's past relationship with the City; F. The impact on the ability of the City to comply with laws and rules relating to contracting with historically underutilized businesses and nonprofit organizations employing persons with disabilities; and G. The total long-term cost to the City to acquire the bidder's goods or services. Rejection of Bids. The City Council reserves the right to reject any or all bids at any time. The City reserves the right to adopt the most advantageous interpretation of the Bids submitted in the case of ambiguity or lack of clearness in stating bid prices, to reject any or all Bids, and/or to waive formalities. 4.03 WAIVER OF CLAIMS. BY SUBMITTING A BID, EACH BIDDER AGREES TO WAIVE AND DOES HEREBY WAIVE ANY CLAIM THE BIDDER HAS OR MAY HAVE AGAINST THE CITY OF SAGINAW, TEXAS, AND THE CITY'S RESPECTIVE OFFICERS, OFFICIALS, EMPLOYEES, AND REPRESENTATIVES, IN BOTH THEIR OFFICIAL AND PRIVATE CAPACITIES, FOR THE AWARD OF DAMAGES OR ATTORNEY FEES, ARISING OUT OF OR IN CONNECTION WITH THE ADMINISTRATION, EVALUATION, OR RECOMMENDATION OF ANY BID, WAIVER, DELETION, OR AMENDMENT OF ANY REQUIREMENTS UNDER THESE BID SPECIFICATIONS, ACCEPTANCE OR REJECTION OF ANY BIDS, AND AWARD OF THE BID. BY SUBMITTING A BID, THE BIDDER SPECIFICALLY WAIVES ANY RIGHT TO RECOVER OR BE PAID ATTORNEY FEES FROM THE CITY OF SAGINAW, TEXAS, OR ANY OF THE CITY'S EMPLOYEES AND REPRESENTATIVES UNDER ANY OF THE PROVISIONS OF THE TEXAS UNIFORM DECLARATORY JUDGMENTS ACT (TEXAS CIVIL PRACTICE AND REMEDIES CODE, SECTION 37.001, ET. SEQ., AS AMENDED). THE BIDDER ACKNOWLEDGES AND AGREES THAT THIS IS THE INTENTIONAL RELINQUISHMENT OF A PRESENTLY EXISTING KNOWN RIGHT AND THAT THERE IS NO DISPARITY OF BARGAINING POWER BETWEEN THE BIDDER AND THE CITY OF SAGINAW, TEXAS. 4.04 Acknowledgment. By execution and submission of this Bid, the bidder hereby represents and warrants to the City of Saginaw that the bidder has read and understands these Bid Specifications and that the Bid is made in accordance with the terms stated herein. Bidder acknowledges that it understands all terms herein, which include the waiver provisions, and that it had the right to consult with counsel regarding all applicable documents. 4.05 Agreement. Upon award of Bid to Contractor, the terms and conditions of these Bid Specifications will become incorporated into this agreement between the City and Contractor. 4.06 Bonds. Maintenance, performance, and payment bonds will be required for this Project. The City of Saginaw will require at least a _1_-year workmanship warranty and a maintenance bond insuring prompt maintenance, repair, and/or replacement of the Generator for a period of _3_ years from the date of acceptance by the City. Please specify any other warranties you are providing. 4.07 Work References. All Bidders must be prepared to provide at least three (3) references from current or past customers receiving the same or similar service(s). Include the name of entity, contract name, and telephone number. Do not submit references with this RFP
