The County of Kern (County) will receive sealed Bids for construction on a facility in accordance with the plans and special provisions therefor to which special reference is made as follows: For Construction of Taft Airport Runway Crackfiling and Slurry Seal. No bid will be considered unless it is made on a Bid form furnished by the County's Public Works Department (Department) and accompanied by bidder's security in an amount equal to 10% of the amount bid in accordance with the provisions set forth under Section 2, "Bidding," of the Standard Specifications of the State of California Department of Transportation, dated 2018, as modified by the special provisions. The successful bidder must complete the work, including plant establishment work, within 30 working days. The County reserves the right to reject any and all bids. If the contract is to be awarded, it will be awarded by the Board of Supervisors to the lowest responsible bidder whose bid complies with all prescribed requirements. The successful bidder must furnish a Performance Bond and a Payment Bond each in the amount of 100% of the contract price and on the County's form. Pursuant to Public Contract Code Section 22300, the substitution of securities for money withheld by Kern County to ensure performance of the contract will be permitted. All documents submitted in compliance with the requirements of this bid package and the contract must be scannable and photocopiable. Each bidder must be licensed as required by law at the time the contract is awarded. Failure of the bidder to obtain proper and adequate licensing for an award of a contract shall constitute a failure to execute the contract and shall result in the forfeiture of the security of the bidder. The contractor license classification required for this project is: A or C-12. If there is a difference between the minimum wage rates predetermined by the United States Secretary of Labor and the prevailing wage rates predetermined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and all subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question.
