Responding bidder, should inspect and determine pre-existing conditions, prior to submitting a response. Submittal(s) should contain one (1) original bid response and one (1) duplicate/copy of the bid response, for a total of two (2) complete responses. The original and copy can be in the same envelope, box or container and should be clearly marked as "Original" and "Copy". Bid Withdrawal, Bid Change and Alternate Bid a. Bidders may withdraw Bid(s) at any time prior to the official opening. b. To guarantee the authenticity of the change, responding bidder, shall initial alterations made prior to bid opening date and time. c. After the official opening, bids may not be amended or altered, and may not be withdrawn without the approval of Commissioners Court. d. McLennan County reserves the right to accept or reject, in part or in whole, any bids submitted; and to waive any technicalities, informalities or defects if deemed in the best interest of the County. 2.8. Scanned or Re-typed Response: If, in its response, the responding bidder, either electronically scans, re-types, or in some way reproduces the County's published bid package, then in the event of any conflict between the terms and provisions of the County's published bid package, or any portion thereof, and the terms and provisions of the response made by the Bidder, the County's bid package as published shall control. Furthermore, if an alteration of any kind to the County's published bid package is only discovered after the contract is executed and is or in not being performed, the contract is subject to immediate cancellation. 2.9. No Commitment by McLennan County: This Invitation to Bid, does not commit McLennan County, to award any contact, or to pay any costs associated or incurred in the preparation and response to this bid, to procure or contract for the requested good(s) and/or service(s). Bid Bond(s): Bids shall be accompanied by a certified check or bid bond in the amount of five percent (5%), of the proposed price. 4.2. Performance and Payment Bond(s): Contractor, shall provide a performance bond in the amount of the bid conditioned on faithful performance of the work for the Project in accordance with the plans and specifications. Said bond shall be executed by a corporate surety or sureties duly authorized by the State of Texas to issue surety bonds. Said bond(s) shall be in the form required by Texas law, and acceptable to the Owner, and shall be payable to the Owner. Note: Performance Bond is not required if proposed amount is less than $100,000. a. Contractor shall provide a payment bond guaranteeing payment of laborers, contractors, subcontractors, and materialmen in the full amount of the GMP for the Project work. Such bond shall be executed by a corporate surety or sureties duly authorized and admitted to do business in the State of Texas to issue surety bonds. Said bond(s) shall be in the form required by Texas law, be in a form acceptable to the Owner and be payable to the Owner. If a GMP has not yet been agreed to, the bond shall be in the sum of the Project Budget. Once a GMP has been agreed to, the payment bond may be reformed to be in that amount. b. The Performance (if required) and Payment Bonds shall be provided by the Contractor to the Owner not later than the 10th day after this Agreement is executed Retainage: A five percent (5%), retainage will be held to the completion of the project if progress payments are requested for this project. a. The McLennan County Engineer, shall be the Owner's Representative and will be responsible for the final inspection and acceptance. Ability to begin work within thirty (30) calendar days from, notice to proceed, NTP a. Weather days, per se, will not be included in the contract. However, during periods when high river flow prevents access to the site or will not allow the contractor to safely or effectively perform work, McLennan County may temporarily stop time on the contract until such time as flow levels recede and allow work to resume. It is the contractor's responsibility to notify the County in writing of such events within 24 hours of such occurrence." b. If the work is not completed within the time stipulated, the Contractor shall pay to the County as fixed, agreed, and liquidated damages (it being impossible to determine the actual damages occasioned by the delay) the amount of ($150.00) for each calendar day of delay, until the work is completed. The Contractor and Contractor's sureties shall be liable to the County for the amount thereof. Note: We are not aware of any Covid-19 issues that would delay the completion of this project.
