CONTRACTOR is required to have registered with the DLI prior to bidding on this project and all laborers and mechanics employed by the CONTRACTOR or Subcontractors in performance of the construction work shall be paid wages at rates as required by the Laws of the State the work is being performed. The CONTRACTOR must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin. Each bid or proposal must be accompanied by a certified check, cashier's check, or bid bond payable to the OWNER, in an amount not less than ten percent (10%) of the total amount of the bid. Successful bidders shall furnish an approved Performance Bond and a labor and materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance, as required, shall be provided by the successful bidder(s) and a certificate(s) of that insurance shall be provided. The bid bond, a copy of the certificate of renewal, and applicable funding requirement forms shall be included with each bid of proposal. All bids must be sealed. No bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses, and any deficient bid submitted will be resealed and returned to the Bidder immediately. The OWNER reserves the right to hold all bids and bid securities for a period not to exceed thirty (30) days and to hold the three low bids and bid securities for a period not to exceed ninety (90) days from the date of the bid opening. The OWNER may, in its sole discretion, release any Bid and return the Bid security prior to the end of these periods, waive any informality in any bid, and to reject the bid of any party who has been delinquent or unfaithful in the performance of any former contract with the OWNER.
