The Village reserves the right to reject any or all bids and to waive any informality therein. The Village will not award a contract to any bidder who cannot prove to the satisfaction of the Board of Trustees of the Village that he has had sufficient experience in this type of work and is financially able and organized to successfully carry out the work covered by the Plans and Specifications in the required time. The successful bidder will be required to execute the contract documents and to furnish insurance and bonds as stipulated in the contract before any work may be performed. The Village shall not be bound by the terms of the contract and shall not be liable for payment on account of any work performed either under the contract or in quantum meruit until the contract documents have been executed and the necessary insurance and bonds have been applied. Bidders are warned that the estimate of the quantities of the various items of work are approximate and given solely to be used as a uniform basis for the comparison of bids. The quantities actually required to complete the contract of work might be less or more than so estimated and, if so, no right to recover damages or loss of profits shall accrue to the Contractor by reason thereof.
