The following are general terms and conditions that will be in the Contract as awarded to the Contractor with the winning Bid. All the relevant Contract terms regarding the Product and/or any Services and duties to be provided by the Contractor, including fees and payment, shall be included in the Contract when the Contract is awarded, whether by Purchase Order or written Contract. By submitting a Bid, the Responding Contractor agrees to abide by the terms and conditions contained therein. If the notice to Bidders required the submission of the Bid Guaranty/Performance Bond, but the Performance Bond was not submitted as a Combination Bid Guaranty/Performance Bond with the Selected Bidder's Bid, the Commission will send the Performance Bond Form to the Selected Bidder. The Selected Bidder must execute the Performance Bond with its surety and return the signed instrument to the Commission within ten (10) days. Thereafter, the Commission will issue the Purchase Order to the Selected Bidder. The Commission reserves the right to reject any and all Bids and to waive minor technicalities or minor irregularities.
