In case he is notified in writing by mail, telegraph, or delivery of the acceptance of this proposal within thirty-five (35) days after the time set for the opening of bids, the undersigned agrees to execute within ten (10) days a contract (Form of Agreement between Contractor and Owner, Refer to General Conditions) for the work for the above stated compensation and at the same time to furnish and deliver to the Owner a Performance Bond and a Payment Bond both in an amount equal to 100% of the contract sum. The contractor and all subcontractors are required to have registered and be authorized to use Federal Work Authorizations Program Employment Eligibility Verification (EEV) in accordance with Georgia law O.C.G.A. 13-10-91 Illegal Immigration Reform and Enforcement Act of 2011. Contract, if awarded, will be on lump sum basis. No bid may be withdrawn for a period of 35 days after time has been called on the date of opening. Bids must be accompanied by a bid bond and in an amount not less than 5% of the base bid. Both performance bond and a payment bond will be required in an amount equal to 100% of the contract price. The Owner reserves the right to reject any or all bids and to waive technicalities and informalities and to award the project on whatever basis is in the interest of the Owner.
