Such checks and Bonds shall be drawn to the order of the Borough of Prospect Park and will be held as a Guarantee that in the event the Bid is accepted and a Contract awarded to the bidder, the Contract shall be duly executed and its performance properly secured. In default thereof, the bid security will be forfeited to the aforesaid Owner as liquidated damages. Bids shall also include a Consent of Surety obligating the issuing surety to provide the bidder, if awarded a contract for the Project, with performance and payment bonds as required by the Project Specifications. The successful bidder shall furnish and deliver to the Owner a performance bond and a payment bond, each in the amount of 100 percent of the accepted bid amount as security for the faithful performance and payment of the Contract. Further, the successful bidder must furnish the policies and Certificates of insurance required by the Contract The Owner reserves the right to reject any and all bids, to waive informalities or Irregularities in the bids received as permitted by law, and to accept the bid from the lowest responsible bidder.
