The bonds shall be signed by both Contractor and Surety and properly notarized on the City's provided forms or such other forms as required by City. Should any bond required hereunder or any surety on such bond become or be determined by City to be insufficient, it shall be replaced within ten (10) Days by a bond that fully complies with the requirements of Article 11.2 (Bond Requirements) of the City's General Conditions. No further payments to Contractor for Work performed shall be made or due until Contractor has fully complied with all the requirements. Each Bid must be accompanied by a certified or cashier's check made payable to the City of Santa Monica, or a Bidder's bond (using the form provided in the Bid Form) for an amount equal to at least ten percent (10%) of the amount bid as a guarantee that the Bidder will enter into a contract with the City. Bid bonds (or cashier's checks) must be scanned and uploaded into ProcureNow. The City of Santa Monica's Living Wage Ordinance, Santa Monica Municipal Code Chapter 4.65, requires the payment of Minimum Wage for work done on any Contract over a certain threshold to any worker who does not actually work as a manager, supervisor or confidential employee, and who is not required to possess an occupational license. The established Minimum Wage includes an annual adjustment each July 1st by an amount corresponding to the previous calendar year's change in the Consumer Price Index for Urban Wage Earners and Clerical Workers in Los Angeles, Riverside and Orange Counties. The Contractor and Subcontractors shall be licensed in accordance with the provisions of Chapter 9, Division 3, of the Business and Professions Code of the State of California and submit the number and classification of said licenses with the Bid Documents.
