(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is 75N95023Q00494 and the solicitation is issued as a request for quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13--Simplified Acquisition Procedures; and FAR Part 12--Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA), on behalf of the National Center for Advancing Translational Sciences (NCATS), intends to negotiate and award a Firm Fixed Priced contract without providing for full and open competition (including brand-name) to the following for the repair of its BioRad Automated Droplet Generator: BioRad Laboratories Inc. 2000 Alfred Nobel Drive Hercules, CA 94547 This acquisition is conducted as non-competitive for a commercial item or service and is conducted pursuant to FAR 13.106-1(b)(1). The rationale for the sole source justification is that only BioRad Laboratories Inc. can furnish all the requirements, equipment parts, and technology, to the exclusion of other sources. The service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The service and replacement manifold must coordinate, connect, or interface with the existing system, functioning properly and successfully generating droplets for Droplet Digital PCR (ddPCR). Selecting another vendor will be detrimental to the part replacement and to the equipment's proper function. (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) Number 2023-04 dated June 2, 2023. (iv) The associated NAICS code is 811210 - Electronic and Precision Equipment Repair and Maintenance and the size standard in millions of dollars is $34.0 million. This requirement is non-competitive with no set-aside restrictions. (v) The Stem Cell Translation Laboratory (SCTL) at the National Center for Advancing Translational Sciences (NCATS) requires repair services for its BioRad's Automated Droplet Generator. The Contractor shall 1) verify why sensors and manifold are not working properly, 2) verify the cause of error messages, and 3) ensure that operational systems and software are up to date. Once problems are identified as well as their source, the Contractor shall 4) take corrective measures to fix them and replace malfunctioning parts. These services will be utilized by the SCTL to restore its capacity to run ddPCR experiments for multiple projects, analyzing gene expression of many different markers during the development of iPSC differentiation protocols. (vi) The Contractor shall perform the following repair services: 1. Identify the issue source 2. Replace any malfunctioning parts 3. Perform a mock run to ensure good shape and proper functioning 4. Evaluate equipment performance 5. Interpret any error message 6. Verify potential oil leakage 7. Evaluate software performance 8. Take any additional actions necessary to fix the instrument (vii) The Government anticipates award of a firm fixed-price contract for this acquisition, and the anticipated period of performance will be a 30-day period after receipt of the order. The Contractor is expected to work for for 1-2 days within the period of performance, depending on the Contractor's personnel availability. The place of performance will be at 9800 Medical Center Drive, Room B218, Rockville MD, 20850. (viii) The provision at FAR 52.252-1, Solicitation Provisions Incorporated by Reference (Feb 1998), applies to this acquisition. The following factors shall be used to evaluate quotes: a. Technical capability of the item offered to meet the Government requirement; b. Price; and c. Past performance [see FAR 13.106-2(b)(3)]. (x) The Offerors to include a completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications-Commercial Items (Dec 2022), with its offer. If the offeror has completed FAR clause 52.212-3 at www.sam.gov, then the offeror does not need to provide a completed copy with its offer. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services (Dec 2022), applies to this acquisition. Addendum to this FAR clause applies to this acquisition and is attached. (xii) There are no additional contract requirement(s) or terms and conditions applicable to this acquisition. (xiii) The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement. (xiv) Responses to this solicitation must include clear and convincing evidence of the offeror's capability of fulfilling the requirement as it relates to the technical evaluation criteria. The price proposal must include the price for each line item and the total price. The Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response.
