CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents for the Red River Sewer Forcemain Bore. The Work includes but is not limited to installing a 16 diameter steel sewer line under the Red River, via horizontal direction drill. Directional drill pipe length is approximately 4,832-LF. The pipeline shall be blind flanged at both bore pipes for future connection. Each Bid must be accompanied by Bid security made payable to Owner in an amount of five percent (5%) of the Bidder's maximum Bid price and in the form of a certified or cashier's check or a Bid Bond (Section 00410) issued by a surety meeting the requirements of Paragraph 6.01 of the General Conditions and Paragraph 6.3 below The award of a contract, if awarded, will be made to the lowest responsible and responsive bidder whose bid complies with all requirements prescribed within 45 calendar days after the bid opening. However, when the contract is to be financed by bonds which are required to be sold after receipts of bids, or when the contract is to be financed in whole or part by federal or other funds not available at the time bids are received, the time will not start until receipt of federal and/or state concurrence or concurrence of the other funding source. Accordingly, instead of requiring any such proof, CONTRACTOR and Surety agree to forfeit and pay OWNER as liquidated damages for delay (but not as a penalty) the amount of $1500 for each calendar day that expires after the Contract Time specified in Paragraph 3.1 for substantial completion until the Work is substantially complete; and $1500 for each calendar day that expires after the time specified in Paragraph 3.1 for final completion and ready for final acceptance until the Work is completed.
