ADVERTISEMENT FOR BIDS July 2023 Notice to Bidders: Qualified bidders may submit bids for project as described in this Document. Project Identification: WATER TOWER PARK RENOVATION PROJECT: DNR#1800675 Owner: Michigan City Parks and Recreation Department, 100 E Michigan Blvd., Suite 2, Michigan City, IN 46360. Engineer: Jones Petrie Rafinski, 325 S. Lafayette, Blvd., South Bend, IN 46601 Project Description: This project will include the construction of a new 13 space off-street parking lot located south of Broadway Avenue, and includes earthwork, demolition, expanded ADA accessible HMA walkways, concrete curb, pedestrian crosswalk connections to the surrounding neighborhood, a new playground with new equipment and relocated existing equipment, a basketball court and pickleball courts. This project is being funded with Land and Water Conservation Fund and Community Development Block Grant monies and all relevant requirements will apply. Wage rates on this project shall not be less than the Federal Davis Bacon wage scale published by the U.S. Department of Labor. The project consists of furnishing all labor, materials, services, equipment, tools, transportation, and miscellaneous equipment necessary for the construction of the Water Tower Park Renovation project per the Project Manual, Construction Drawings and Specifications. BID SUBMITTAL AND OPENING Owner will receive sealed bids until the bid time and date at the location given below. Owner will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and delivered as follows: Any bid received after the Deadline will be returned to the bidder unopened. After opening the bids, the Board will take all bids under advisement and refer them to the engineer for review and tabulation. All bid documents may be obtained from the following sources: (1)Following request for the Construction Drawings and the Project Manual by the potential bidder, Jones Petrie Rafinski (JPR) will provide appropriate file sharing permissions to view and download these documents. (2) Hard copy documents may be viewed in person at Michigan City City Hall, 100 E Michigan Blvd., Suite 2 (lower level), Michigan City, IN 46360 (3)For bidding purposes, additional sets of project documents will be available to contractors at a cost of $25.00 per set (no partial sets) and $25.00 per manual (no partial manuals). The fee shall be in the form of a check made payable to Jones Petrie Rafinski when picking up documents. Refunds will not be available for any project sets or manuals. Neither the Michigan City Parks and Recreation Department nor its Engineer will be responsible for partial sets of documents so obtained from any other source. Bids shall include all information requested by Indiana Form 96 included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. The Bidder shall also submit a statement of experience, a proposed plan or plans for performing the public work, and the equipment that the Bidder has available for the performance of the public work on forms prescribed by the State Board of Accounts. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the owner all such information and data for this purpose as the owner may request. The owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein. Any deviation from the bid documents must be explained by bidder. All questions regarding the project following the site visit shall be emailed to the Engineer at ablomeke@jpr1source.com no later than 5:00 PM (CST) Friday, September 1. The work to be performed and the proposal to be submitted shall include sufficient and proper sums for all general construction, mechanical installation, labor, materials, permits, licenses, insurance, and so forth incidental to and required for the construction of the Project. The Contractor shall submit an itemized proposal for the approximate quantities and components of labor and materials to complete the contract. Said proposal shall be upon the standard bid sheet used by the Michigan City Parks and Recreation Department, and said sheet must contain an authorized signature of the Contractor, together with a starting date and completion date, or the bid of the Contractor may, at the discretion of the Owner, be rejected and declared invalid. The proposal shall be accompanied by a non-collusion affidavit as required by the statutes of Indiana. Bids shall be included in a sealed envelope, bearing the title of the Project and the name and address of the bidder. BID SECURITY Bid security shall be submitted with each bid in the amount of 5% of the bid amount. Bid security shall be a certified check or bid bond and shall be the bidder's guarantee that said bidder will, if the contract is awarded to said bidder, execute within ten (10) days of acceptance of the bid, a Contract for the work bid upon. All bid bonds shall be made payable to the Owner and be executed by a surety company authorized to do business in the State of Indiana. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities. An out-of-state contractor will have Indiana State Gross Income Tax withheld by the Owner, unless they can show proof that they are registered with the Indiana Secretary of State to conduct business in the State of Indiana. TIME OF COMPLETION Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time. It is the intention of the Owner that construction of the project will start as early as October 4, 2023, dependent upon Community Development Block Grant funds being release on October 1, 2023. This project will have a 9-month construction timeframe, with a substantial completion June 15, 2024. BIDDER'S QUALIFICATIONS Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. The successful bidders will be required to furnish Performance and Payment Bonds for one hundred percent (100%) of their contract amount prior to execution of contracts. Bonds shall be in full force and effect for a period of at least 12 months after the date of final completion and acceptance of the longest guarantee provided under the contractor's contract. Should the contractor's bonding company default; the contractor will be responsible for securing a new bond within fourteen (14) calendar days. Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time he executes his contract. The bond will be in the amount of 100% of the Contract Price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion. Liquidated damages in the amount of Five Hundred Dollars ($500.00) per day of delayed or unsatisfactory completion of the Contract, beyond the agreed upon completion date, shall be paid by the Contractor to the Michigan City Parks and Recreation Department pursuant to the terms and conditions of the written contract ultimately entered into by the successful Bidder and Michigan City Parks and Recreation Department. The right to reject any or all Bid Proposals, either in whole or in part, or to waive any informalities therein is reserved by the Owner.
