Pursuant to Public Contract Code section 20111.6, prequalification of the prime contractor (bidder), and of its mechanical, electrical, and plumbing (“MEP”) subcontractors (C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and C-46), is required for the bidder to submit a bid on this project. Prospective bidders and their MEP subcontractors (1) are required to submit to the Owner a completed prequalification questionnaire and financial statement, on forms provided by the Owner, no later than ten business days prior to the date fixed for the public opening of sealed bids, and (2) must be announced as prequalified no later than five business days prior to the date fixed for the public opening of sealed bids. If the Contract is subject to prevailing wage monitoring and enforcement by the DIR, as indicated in the Notice Calling for Bids, the successful bidder and all subcontractors will be subject to the requirements of Subchapter 4.5 of Chapter 8 of Title 8 of the California Code of Regulations. The successful bidder and all subcontractors will be required to furnish certified payroll records to the DIR on the frequency specified in the Notice Calling for Bids using the DIR’s eCPR system. To enroll or obtain additional information and assistance, bidders may go to the website at https://apps.dir.ca.gov/eCPR/DAS/altlogin. Failure to timely submit certified payroll records may result in debarment from public works projects by the Labour Commissioner for a period of one to three years. The Owner reserves the right to reject any or all bids, or to waive any irregularities or informalities in any bids or in the bidding process, as allowed by law. If two identical low bids are received from responsive and responsible bidders, the Owner will determine which bid will be accepted by lot, pursuant to Public Contract. Each bid shall be accompanied by a bid security in cash, a certified or cashier’s check, or bid bond in an amount not less than 10 percent of the total bid price payable to the Owner. The bid security shall be given as a guarantee that if awarded the contract the bidder will execute and return the Construction Agreement within 10 working days after award of the contract and will furnish on the prescribed forms a satisfactory Payment (labor and material) Bond and separate Performance Bond, in accordance with the Contract Documents and Civil Code Sections 9550 et seq., and certificates evidencing that the required insurance is in effect in the amounts set forth in the Contract Documents. In case of refusal or failure to timely execute the Construction Agreement and furnish the required bonds and insurance certificates, the bid security shall be forfeited to the Owner. If the bidder elects to furnish a bid bond as its bid security, the bidder shall use the bid bond form included in the Contract Documents, unless the Owner elects to waive the use of the form provided, in its sole discretion
