Site work and paving for a mixed-use development in Houston, Texas. Completed plans call for site work for a 114,460-square-foot road / highway; for paving for a road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.
The project involves reconstructing Bering Drive from a two-lane roadway with roadside ditches to a curb and gutter roadway with storm sewer and cut-back parking. The project also involves sidewalks with ADA compliant wheelchair ramps, driveways, pavement markings, signage, speed cushions, etc. THE CITY'S RIGHT TO STOP THE WORK. If Contractor fails to carry out the Work in accordance with the Contract, or fails to correct work which is not in accordance with requirements of the Contract as required in Sections 12.1 and 12.2, the City may, by Notice of Noncompliance, order Contractor to stop the Work or any portion of the Work until the cause for the order has been eliminated. However, the right of the City to stop the Work will not give rise to a Claim for delay or to a duty on the part of the City to exercise this right for the benefit of Contractor or any other person or entity, except to the extent required by Section 6.2. If Contractor corrects the defective or nonconforming work within the time established in Notice of Noncompliance, City Engineer will give written notice to Contractor to resume performance of the Work. Estimate: 4,531,981.50 Yes. Liquidated damages will be $1200.00 per day.
