plans or in the specifications by reference to manufacturer's or vendors' names, trade names, catalog numbers, etc., it is intended merely to establish a standard; and, any materials, article or equipment of other manufacturers and vendors which will perform adequately the duties imposed by the general design will be considered equally acceptable provided the material, article or equipment so proposed, is, in the opinion of the City of equal substance and function. Successful vendor must obtain a business license from the City of Owensboro. The City of Owensboro reserves the right to accept or reject any and all bids received, to take exception to these bid specifications, or to waive any informalities, to negotiate all terms and conditions, or to cancel or amend in part, or entirety, this bid. The right is also reserved to award bids based on the best interest and/or most advantageous to the City of Owensboro. Cash, Cashier's Check, must accompany each bid or a Bid Bond duly executed by the bidder as principal and having as surely thereon a surety company approved by the City, in the amount of five percent (5%) of the bid. All work shall be completed within 120 days from the issuance of a PO from the City. Circumstances beyond the contractor's control will be taken into consideration.
