Pursuant to Massachusetts General Law c. 30B, the Town of SPENCER ("Town") as the Awarding Authority, through its Chief Procurement Officer (Town Administrator), hereby issues a Request for Proposals ("RFP") seeking proposals from qualified consultants or companies to develop a program to aggregate the electrical load of electricity users within the Town, both residential and commercial, and, in consultation with the Massachusetts Department of Energy Resources ("DOER") and the Massachusetts Department of Public Utilities ("Department"), develop, prepare, implement, secure regulatory approval and perform all services related to administering the Town's Municipal Aggregation Program as defined by and in compliance with all applicable provisions of M.G.L. c. 164, 134, as amended, and any other applicable statute or regulation related to this process, including 220 C.M.R. 11.00, D.T.E. 06-102, D.T.E. 06-104 and the policies and procedures of both the DPU and the DOER.
The Town will not be responsible for the premature opening of any proposal not properly identified, and any such proposals will be rejected. The Town intends to select and enter into an agreement (the Contract or this Agreement) with the most highly qualified Proposer for a term of five (5) years commencing as of approximately Friday, 12/1/23. The Town endeavors to expedite the award and execution of the contract documents. The Contract will be awarded within thirty (30) calendar days after the proposals are due. Within five (5) calendar days of the date of the award of contract, the Contract will be executed by the Town and the Proposer to whom the award of contract has been made. Said time deadline may be extended by mutual agreement. Services under the Contract will commence as soon as practical thereafter. Questions concerning this RFP must be submitted in writing to: Town Administrator, Jeff Bridges, JBridges@SpencerMA.gov by 4:00 pm on Thursday, 9/14/23. Questions may be delivered, mailed, or emailed to: Jbridges@SpencerMA.gov. Written responses will be posted . All questions and answers will be incorporated into this RFP. The Town reserves the right to cancel this RFP, or reject in whole or in part any and all proposals, if the Town determines that cancellation or rejection serves the best interests of the Town. There is no pre-proposal conference scheduled for this RFP. All proposal prices submitted in response to this RFP must remain firm for ninety (90) days following the proposal due date. The method of Contractor Selection has not been Determined at this time.
