Demolition, site work and paving for a mixed-use development in Angola, New York. Completed plans call for site work for a playground / park / athletic field; sidewalk / parking lot; for paving for a sidewalk / parking lot; and for the demolition of a bridge / tunnel.

This project includes work on four (4) sites within Lake Erie Beach Park, designated by FEMA. Site 1 and Site 2 include the installation of large to medium rip rap along the Muddy Creek embankment. Site 3 includes the removal of existing stone and installation of new, heavy armor stone along the existing embankment. Site 4 includes the removal of the pedestrian bridge's existing abutments and installation of new abutments. Utilize the NYSDOT standard sheets, standard specifications and special specifications for material information, construction descriptions, and method of payment. This section clarifies, modifies, deletes from, or adds to the various provisions of all other sections and particular portions of the work. This section shall be used in conjunction with every other section in order to determine the total requirements under each section. Work for this project is included in one (1) construction contract. Only Bidders receiving bid documents from the Issuing Office (electronic or printed) will be allowed to submit a bid to be considered for award. A pre-bid conference will not be held. Bid security shall be furnished in accordance with the Instructions to Bidders. Each bid must be accompanied by a certified bank check or bid bond from a domestic carrier licensed to do business in the State of New York in the amount of not less than five percent (5%) of the amount of the bid submitted. This project is partially funded under U.S. Department of Homeland Security, FEMA and is subject to the applicable clauses described in Appendix II to the Uniform Rules (Contract Provisions for Non-Federal Entity Contracts Under Federal Awards) under 2 C.F.R. 200.326 and contract clauses recommended by FEMA requirements included in the contract documents. Bidders must take all necessary affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus firms are used when possible, if they intend to let any subcontracts for a portion of the work. Please refer to Supplementary Conditions, Article 19.05 in these Contract Documents. Bidders on this work will be required to comply with Executive Orders 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Statement of Non-Collusion: Bidders on the contract are required to execute a non-collusive bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York. Security for Faithful Performance: The successful bidder will be required to furnish Performance and Labor and Material Payment Bonds written by firms licensed to do business in New York State, each in the amount of one hundred percent (100%) of the contract amounts in accordance with the provisions of the Contract Documents. Bidders shall comply with the Iran Divestment Act of 2012. Sales and Use of Tax Exemptions: The Town of Evans is exempt from the payment of sales and compensation use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the Town of Evans pursuant to this contract. Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment, and supplies to be sold to the Town of Evans pursuant to this contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the project. These taxes are not to be included in the Bid. All bids shall be binding for a period of thirty (30) days after the bid opening date.
