Pursuant to the Federal Privacy Act (Section 552 et seq.) and the Information Practices Act of 1977 (IPA) (Civil Code Sections 1798 et seq.), notice is hereby given for the request of personal information by this form. The requested personal information is voluntary. The principal purpose of the voluntary information is to facilitate the processing of this form. The failure to provide all or any part of the requested information may delay processing of this form. No disclosure of personal information will be made unless permissible under Article 6, Section 1798.24 of the IPA of 1977. Each individual has the right upon request and proper identification, to inspect all personal information in any record maintained on the individual by an identifying particular. If your bid is over $388,000.00 it will be rejected per Public Contract Code 10105(b). Payment Bonds and Insurance will be required at time of Award if your Company is low bidder and awarded the contract. DVBE 5% goal is required. California Department of Transportation (Caltrans/Department) has issued the enclosed Invitation for Bid (IFB) for services described in the enclosed Notice to Bidders. Please read the entire agreement package and all attachments carefully. If you desire to bid, complete the Bid Proposal and return the original in a sealed envelope. Your signature affixed to and dated on the bid proposal shall constitute a certification under penalty of perjury, unless exempted, that you have complied with the nondiscrimination program requirements of Government Code Section 12990 and Title 2, California Code of Regulations (CCR), Section 11102, and the nondiscrimination program requirements of Title VI of the Civil Rights Act of 1964, and 49 CFR Part 21. Any business used to meet DVBE requirements must be certified by Department of General Services, Office of Small Business and DVBE Services. Award of this agreement will be to the lowest responsible bidder whose bid complies with all requirements as described in this IFB. Only firms certified as a Small Business, Micro Business, or Small Business for the purpose of Public Works (SB-PW) with the Department of General Services (DGS), Office of Small Business and DVBE Service (OSDS), (or contractors who commit to subcontracting a minimum of 25 percent (25%) of their net bid price to SB, MB, or SB-PW, in the categories most appropriate to accomplish the prescribed services will be granted this preference. B. To claim the SB or MB preference, the contractor must have its principal place of business located in California, satisfy all of the SB or MB requirements, and be certified by the California Department of General Services (DGS), Office of Small Business and Disabled Veteran Business (DVBE) Services (OSDS). The preference amount may not exceed fifty thousand dollars ($50,000) for any bid. If prospective contractor is claiming the five percent (5%) certified SB or MB preference, complete the Request For Small Business Preference or Non-Small Business Preference (DES-OE-0102.7) listed on the General Bidders Instructions/Checklist. Additionally, the contractor may satisfy the non-SB requirements described below. C. Pursuant to Government Code Section 14838 and 2 CCR Section 1896, if a bidder is not a certified SB, but wishes to be eligible for the five percent (5%) non-small business (NSB) preference, the bidder must subcontract at least twenty five percent (25%) of its net bid price to one or more certified SBs. If bidder is claiming the five percent (5%) non-SB (NSB) preference, complete Request For Small Business Preference or Non-Small Business Preference (DES-OE-0102.7) listed on the General Bidders Instructions/Checklist. The bidder shall list the names of all certified SB firms being claimed for credit. For each certified SB subcontractor listed, the bidder shall submit a copy of the quotes from each SB (on the SB's company letterhead). 2. Disabled Veteran Business Enterprise (DVBE) Programs A. DVBE Participation Program with Goals: 1) The required DVBE participation goal for this IFB is five percent (5%). The resultant Agreement is financed with State funds and subject to Public Contract Code Section 10115 et seq., Military and Veterans Code Section 999 et seq., and Title 2, California Code of Regulations, Sections 1896.60 (2 CCR Section 1896.60) et seq., that provides contracting opportunities for qualified DVBEs certified by the DGS. The DVBE Incentive Program may also apply-see paragraph B, DVBE Incentive Program, below. 2) Bidder shall complete and submit the Certified DVBE Summary (ADM-4015) listed on the General Bidders Instructions/Checklist. Bidder shall complete the Certified DVBE Summary (ADM-4015) when the following situations occur: o Bidder is DVBE (prime) Contractor. o Bidder subcontracts with any DVBE firm. Bidder submits with its bid package a completed Certified DVBE Summary (ADM-4015). For each certified DVBE subcontractor listed on the Certified DVBE Summary (ADM-4015) the bidder shall submit the written quote on company letterhead, with a complete description of the work or supplies as proof of commitment. Each quote should be signed by the DVBE Subcontractor or supplier. Failure to provide required DVBE information will result in the bid being rejected as nonresponsive. Bids will be read in Contract numeric order; questions will not be allowed; and information will not be repeated. Bid opening results will be posted online on the Division of Procurement and Contracts web site by 3:00 p.m. on the day following the bid opening. Questions about alleged patent ambiguity of the plans, specifications, or estimate must be asked before bid opening. Under Government Code Sections 14835 et seq. and 2 California Code of Regulations Sections 1896 et seq., the Department gives preference to certified small businesses and non-small businesses who commit to 25 percent (25%) certified small business participation. Under Public Contract Code Section 6107, Department gives preference to a "California company", as defined, for bid comparison purposes over a nonresident contractor from any state that gives or requires a preference to be given to contractors from that state on its public entity construction contracts. Prevailing wages may be required on this Contract under Section 7-1.02K(2). Director of the California Department of Industrial Relations (DIR) determines the general prevailing wage rates. Obtain the wage rates at the DIR Website Bid Bonds Bid bonds are only required for agreements over the threshold set by the Department of General Services, which is currently $388,000.00 (as of December 2022). Contractors are no longer required to purchase and submit a Bid Bond when bidding on Minor B Projects. Section 2-1.34 of the 2022 Standard Specifications is not applicable to Minor B Projects. Contract Bonds If the total bid exceeds $25,000, the successful bidder must furnish a payment bond to secure the claim payments of laborers, workers, mechanics, or materialmen providing goods, labor, or services under the Contract. This bond must be equal to at least 100 percent (100%) of the total bid (Pub. Cont. Code Section 7103). A performance bond is not required. *The list of planholders and/or interested bidders is not being tracked by the stakeholders involved with this project.
