**As of December 5, 2023, project was awarded to Black and McDonald, awarded amount is $880,886.55.** The City of Independence, Missouri's Power & Light Department is soliciting for a contractor who will replace eight (8) wooden electrical poles with galvanized steel structures along US Highway 24 from Grand Avenue to Dodgion Avenue in Independence, Missouri. Modifications will be made only by written addendum. Bidders must acknowledge any addendum by opening and accepting on online LIQUIDATED DAMAGES A. If the contractor shall neglect, refuse, or fail to complete the work within the time set forth above, or any proper extension thereof granted by the City, the contractor shall pay to the City the amount specified in the bid documents for each day the entire work is incomplete. Said obligation of the contractor is not a penalty but is liquidated damages for loss to the City and the public, after the expiration of the time stipulated in the contract, as adjusted by duly executed change orders, and will be deducted from any money due the contractor under the contract. The contractor and the surety of record shall be liable for any and all liquidated damages The contractor shall provide, as stipulated in this ITB, a payment, performance, and maintenance bond for faithful performance of the contract and for persons performing labor or furnishing materials in connection therewith, with sureties satisfactory to the City and in the form provided. This bond shall be in the full amount of the contract and shall have as surety thereon a company authorized to do business in the State of Missouri, qualified as acceptable surety for United States government deposits, and acceptable to the City. The contractor will guarantee that the equipment, materials and workmanship furnished under the contract will be as specified and will be free from defect for a period of two years from the date of final City acceptance. In addition, the equipment or materials furnished by the contractor shall, upon receipt of notice from the City, be repaired or replaced without expense to the City, and the contractor shall save the City harmless from any damage from faulty workmanship or materials installed under the contract. To be complete 129 calendar days after notice to proceed
