No definite date to start** The project consists of modernizing the signal at Bethlehem Pike (SR 0309), Taylor Road (SR 2006) and McLaughlin Road in Montgomery Township. You can also ask questions directly through this tab. When the agency answers the question, both the question and answer is emailed directly to all bidders. Each bid must be accompanied by a bid bond or a certified check in an amount not less than ten percent (10%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders. No bid may be withdrawn for the period of days stated in the bid form from the date the bids are opened. The successful bidder will be required to furnish satisfactory Performance and Payment Bonds in the amount of 100% each of the Contract amount and a Maintenance Bond in the amount equal to ten percent (10%) of the contract amount, thereafter required on the specified Bond Forms included in the Contract Documents and Contractor's Release of Liens. The right is reserved to waive any immaterial defect or informality in the Bid, to reject any or all Bids for any cause whatsoever, to eliminate any item or items from the contract, and to accept any Bid which is deemed most favorable to the Owner, at the time and under the circumstances stipulated. Quantities are not guaranteed and may vary (+/-). EVALUATION OF BIDS AND AWARD OF CONTRACT 19.01 Owner reserves the right to reject any or all Bids, including, without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder due to noncompliance with Bid Specifications and/or prior work history of the Bidder. The successful Bidder shall be required to enter into a written Contract in form to be approved by the Owner. Article 5 of the General Conditions, as may be modified by the Supplementary Conditions, sets forth Owner's requirements as to performance and payment bonds and insurance. When the Successful Bidder delivers the executed Agreement to Owner, it must be accompanied by such Bonds and required insurance certificate(s). A Pre-Bid Conference will not be held for this project. CONTRACT TIME The number of days within which, or the dates by which, the Work is to be substantially completed and ready for final payment are set forth in the Agreement. LIQUIDATED DAMAGES Provisions for liquidated damages, if any, are set forth in the Agreement. Bidder accepts the provisions of the Agreement as to liquidated damages in the event of failure to complete the Work within the times specified above, which shall be stated in the Agreement. Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above, and that Owner will suffer financial loss if the Work is not completed within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner $200.00 for each day that expires after the time specified. The Contractor shall maintain a minimum of one-half of the existing paving width to provide maintenance of traffic in two directions at all locations. All questions about the meaning or intent of the Bidding Documents are to be directed to Engineer by clicking on the Questions tab within PennBid. Interpretations or clarifications considered necessary by Engineer in response to such questions will be by Addenda and posted within the PennBid Documents. Notifications of Addenda will be emailed to all parties recorded by Engineer as having downloaded the Bidding Documents. Questions received after the posted cut-off may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally described as follow: Work includes the Signal Modernization at Bethlehem Pike (S.R. 0309), Taylor Road (S.R. 2006), and McLaughlin Road as identified in the bid plans and specifications.
