Site work, paving and outdoor lighting for a mixed-use development in Olympia, Washington. Completed plans call for site work for a road / highway; for outdoor lighting for a road / highway; for paving for a road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.

Construction of the Nisqually Housing Development Project, including roadway construction of which includes site preparation, drainage, aggregate placement, surfacing, curbs, sidewalks, signing, striping, street lighting, traffic control, and erosion control. Each bid must be accompanied by a cashier's check, money order, or surety bid bond, in an amount not less than five percent (5%) of the total bid made payable to the Nisqually Indian Tribe. A cashier's check, money order, or surety bid bond, in an amount not less than 5% of the total bid, shall be submitted with the Proposal. The Bidder agrees that if this proposal is accepted, he/she will, at that time, deliver to the Owner a 100% Performance Bond and a 100% Payment Bond and will, to the extent of his/her Proposal, furnish all materials, equipment, machinery, tools, apparatus, labor services, and other means of construction and do the work and furnish all the materials necessary to complete all work as indicated in the Specifications The Tribe encourages Disadvantaged Business Enterprises and Indian-Owned Business Enterprises to participate in the competitive bidding process. The lowest bidder may not necessarily be selected as the Tribe will give preference to Indian-owned Contractors and those Contractors including Indian-owned sub-contractors as a part of the General Contractor's bid package Questions about the project during bidding should be directed to Mark Morrison, P.E. of Womer & Associates at 509-534-4884 or mark@wwomer.com. Sureties that execute the bonds required by these documents including bid bonds and performance and payment bonds shall be licensed to conduct business in the State of Washington and be named in the current list of "Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and as Acceptable Reinsuring Companies" as published in Circular 570 (Amended) by the Audit Staff Bureau of Accounts, U.S. Treasury Department. All bonds signed by an agent must be accompanied by a certified copy of the Authority to Act. The Contractor shall pay any license fees or royalties and assume all costs incidental to the use of incorporation of any invention, design, process, product, or devise which is the subject of patent rights or copyrights held by others. The Contractor shall indemnify and hold harmless the Tribe from and against all claims arising out of any infringement of patent rights or copyrights resulting from the use or incorporation of any invention, design, process, product, or device in supplying the equipment called for in the documents. Liquidated damages shall be $500.00 per calendar day beyond the contract completion date. Should the Contractor fail to complete the contract work in the time agreed upon in the contract or within such extra time as may have been allowed for delays by extensions granted as provided in the contract, the Contractor shall reimburse the Tribe for the additional expense and damage for each calendar day that the contract work remains incomplete after the contract completion date. Required Coverages: The insurance shall provide the minimum coverages set forth below, all coverages, $1,000,000 per occurrence, with no deductible. Contractor shall be required to pay the current Davis-Bacon wage scale in effect in this area, including all fringe benefits or the minimum rates established by the Secretary of Labor, whichever is greater. All crafts and trades are applicable. (See Appendix A - Davis-Bacon Wage Determinations for Highway Construction-Thurston County.) For a federal contract in excess of $2,000.00, a contractor is required to pay the Davis-Bacon wage rates and shall post in a location readily visible to workers at the job site. This contract may be canceled by the Tribe upon thirty (30) days written notice. Cancellation is at no additional cost or penalty to the Tribe. The Nisqually Indian Tribe of the Nisqually Reservation (Tribe) reserves the right to reject any or all bids, waive any informality, to accept any alternate bids, and to make such award that it deems to be in the best interest of the Tribe
