Each bid shall be accompanied by a Certified or Cashier s check payable to the order of the Brownsville Public Utilities Board, City of Brownsville, Texas for a sum not less than five (5%) percent of the total amount bid. If the BIDDER fails to execute the contract and to furnish satisfactory Performance and Payment Bonds and Insurance Certificates within ten (10) days from the date on which he is notified that his bid has been accepted, the amount of his check or bid bond shall be forfeited to the Brownsville PUB as mutually agreed to liquidated damages, and not as a penalty. The Brownsville PUB specifically reserves the right to reject any or all bids, to waive irregularities or informalities in any or all bids and to accept any bid which is deemed to be in the best interest of the Board. This contract shall be for a period of two (2) years from date of purchase order with the option to renew annually for an additional two (2) one-year periods if service and price are satisfactory, and the renewal is agreed upon in writing by both parties.
