E-Rate Infrastructure Hardware and Installation. The District reserves the right to reject all proposals and not make a decision, or to contract for only a portion of the project. All costs for proposal preparation are the responsibility of the Proposer. Each proposal must conform and be responsive to this invitation; the information for proposers, specifications, and all other documents comprising the pertinent award agreement documents and submitted on the printed forms provided by the District. LIQUIDATED DAMAGES The District shall hold the successful Proposer submitting an RFP liable and responsible for all damages, which may be sustained because of his/her failure to comply with any condition herein. If the successful Proposer submitting an RFP fails to furnish or deliver any materials, supplies, equipment or other services at the price quoted, or at a time and place stated, or otherwise fails to comply with the terms of this RFP in its entirety the agreement will be canceled and, the District may purchase the services herein specified elsewhere, without further notice to the successful Proposer submitting an RFP. Additional cost accrued by the District through this purchase will be deducted from any unpaid invoices. Proposers are advised that the District reserves the right to reject a proposal that cannot demonstrate the ability to provide the services required. Past service and delivery performance with a similar sized organization and scope of work is a factor in the determination of award of this RFP. Proposers' past performance practices and service to the District will be examined. Responses to inquiries will be posted no later than December 15, 2023 In accordance with California Labor Code Section 1770 et seq. payment of the appropriate general prevailing rate of wages for all crafts employed on the public works site is required of the Contractor and all subcontractors. Compliance with California Education Code Section 45125.1 mandating fingerprinting requirements applies to this project.
