Board of Commissioners of the Port of New Orleans (Board) is seeking proposals from qualified firms licensed to do business in the State of Louisiana or "Prime Consultant(s)") who have demonstrated commensurate experience and expertise for providing As-Needed Material Testing Services as described in Attachment "A". The Board may select up to three (3) Prime Consultants to each enter into a three (3) year agreement for as-needed Services. The Services shall be based on an hourly rate fee schedule for an amount not to exceed $250,000.00 for the term of the agreement. While the agreement will be between a Prime Consultant and the Board, the Prime Consultant can develop teams consisting of sub-consultants. The Board is NOT required to award any agreement based solely on proposal pricing and may cancel this Request For Proposals and not award an agreement in its sole discretion for any reason. The Board is an independent political subdivision of the State of Louisiana and is therefore subject to the Louisiana Public Records Act at La. R.S. 44:1, et seq. Accordingly, any and all information submitted in response to this RFP may be subject to release to others as a result of a public records request. Marking information as confidential will not reduce this possibility. Costs of preparation or any other costs incurred to respond to the RFP and any costs associated with any administrative or judicial proceedings resulting from the solicitation process are the sole responsibility of the Respondent. All questions will be answered via addenda and will be posted on the Board's website at Electronically. The Board will make every effort to administer the proposal process in accordance with the terms and dates outlined in the request for proposals, but the Board reserves the right to modify the proposal process and dates as deemed necessary. The Board encourages the participation of DBE/SBE. In order to receive points for participation, Respondents must submit evidence of a current certification from at least one of the following entities: (1) the SLDBE program run by the City of New Orleans, (2) the State of Louisiana's Department of Economic Development's SBE Hudson Initiative program, (3) the Louisiana Unified Certification Program, or (4) the Federal Small Business Enterprise Program. The Board does not have a certification program, but accepts certifications issued by these public entities. Any proposal submitted by a joint venture shall be signed by all parties of the joint venture, together with the title of each. In the event an award is made to a joint venture, the Agreement must be executed by authorized representatives of all parties of the joint venture. One (1) of the parties of the joint venture shall be designated and authorized to represent all parties in said joint venture with regards to coordinating services and receipt of notices all other correspondence under the Agreement. However, it shall be specifically understood that such representation will in no manner relieve the other parties of the joint venture of any responsibility under the terms and conditions of the Agreement. All payments and invoices under the Agreement shall be in the name of the joint venture. The Board calls the attention of all potential Respondents to the Louisiana Ethics Code, La. R.S. 42:1101, et seq. Those laws prohibit the Board from doing business with any of its current directors or those who have served on the Board within the past two (2) years or from doing business with certain companies with which the following persons are connected. INSURANCE Before an Agreement is executed, the selected Respondent must provide its current certificate(s) of insurance for the types and amounts of coverage as indicated in the Agreement.
