LIQUIDATED DAMAGES Pursuant to Provisions of Exhibit D, Prosecution of Work, liquidated damages are hereby set at $500.00 per day for each day the Contractor fails to complete work past milestones service completion date(s) specified in this Agreement and Notice to Proceed. If progress payments are indicated in the Agreement documents, a faithful performance bond in the sum of not less than one hundred percent (100%) of the total amount payable under the Agreement is required. Payments will not exceed ninety percent (90%) of the Agreement amount. Any funds so withheld may be paid upon completion of the project. The incentive is subject to a minimum of one percent (1%) and a maximum of five percent (5%) and will not exceed $500,000. Bids with DVBE participation of more than five (5%) percent will be calculated with a five percent (5%) incentive. The Contractor hereby agrees to provide all labor, materials, supplies, licenses, permits, equipment and transportation necessary to perform all services required for the foregoing titled work in accordance with the Scope of Work and all Terms and Conditions. The State is not required to award an Agreement and reserves the right to reject any and all bids and to waive any immaterial deviations in the bid.
