SECTION 1. PURPOSE: The purpose of this Invitation to Bid (ITB) is the procurement of timber guardrails in various locations around the City of Roanoke on behalf of the Parks and Recreation department. The City of Roanoke invites any qualified Bidder to respond to this ITB by submitting a Bid for such work, service, and/or items consistent with the terms and conditions herein set forth. SECTION 2. BACKGROUND: The City has several park locations in need of timber guardrail fencing, particularly in areas where new amenities are at risk of damage from unauthorized vehicle traffic in the park. The guardrail is to be positioned along streets, access points, and parking areas to control traffic and prevent unauthorized vehicles from driving onto the turf/park amenities. SECTION 3. SERVICES AND/OR ITEMS REQUIRED: A description and/or listing of the services and/or items that the Successful Bidder will be required to provide to the City under this ITB are those that are set forth in Exhibit 2 of the Sample Contract (Attachment A) attached to this ITB. Each Bidder should carefully read and review all such documents. SECTION 4. REQUIRED QUALIFICATIONS FOR BIDDERS: Offeror should include at least 2 examples of previous Guardrail Installation Work. Offeror must be a Class A Contractor, licensed with the State Board of Contractors. SECTION 5. TIME OF PERFORMANCE: A. The Successful Bidder shall start the performance of any resultant Contract as fixed by a notice to proceed given by the City to the Successful Bidder and fully and completely perform the Contract within 150 consecutive calendar days after such date, all in accordance with the Contract provisions. SECTION 6. PAYMENT FOR SERVICES: Payment(s) to the Successful Bidder shall be made in accordance with the provisions of the resultant Contract, subject to final approval by the City. Each bid of $100,000 or more must be accompanied by a Bid Security in an amount equal to five (5%) percent of the maximum possible bid price in accordance with Sections 2.2-4336 and 2.2-4338 of the Code of Virginia. The Bid Security shall be furnished in one of the following forms: a. Bid Bond, in a form substantially similar to the one provided in the Contract Documents, made payable to the City of Roanoke and properly executed by the bidder as Principal and a Corporate Surety authorized to transact business in the Commonwealth of Virginia. Attorneys-in-fact who execute Bid Bonds must file with the bond a certified copy of their Power of Attorney. b. Certified check, cashier's check, or cash escrow deposited with the City of Roanoke Treasurer in the face amount required for the Bid Security and made payable to the City of Roanoke. c. Personal Bond or Letter of Credit issued by an authorized financial institution in the face amount required for the Bid Security, made payable to the City of Roanoke. These forms of security shall be submitted for review and must be approved by the City Attorney, in his/her sole discretion, at least three (3) business days prior to receipt of bids. Approval will be based upon a determination that the form of security offered will adequately protect the interests of the City as equivalent to a corporate surety's bond. The Bid Security will be returned to all rejected bidders after the City has issued and posted an Award. Should a bid not be accepted by the City within sixty (60) consecutive calendar days after the opening of bids, or within such other time specified in the Bid Documents, each bidder may obtain its Bid Security from the City. Upon the execution of the Contract Documents and approval of the Performance and Payment Securities, the Bid Security shall be returned to the successful bidder. Should the successful bidder fail or refuse to execute the Contract Documents or furnish the required Performance and Payment Securities within the stipulated time, the Bid Security shall be due and paid to the City and the City shall be entitled to collect the Bid Security. In addition, the City may pursue any and all other remedies available to it at law or in equity against said bidder D. Payment terms and delivery date(s) must be shown on the submitted Bid, if applicable. E. All Bids are to be submitted in accordance with all terms, conditions, rules, regulations, requirements and specifications identified in and by this ITB.
