The work to be performed under the specifications herein shall consist of furnishing all material, labor, supervision, tools, supplies, and any other items or expenses necessary to provide comprehensive full maintenance services, repairs, and monitoring of every description, including, but not limited to, adjustments, replacement of parts, batteries, or components, testing and inspections of audio and visual signals as specified by New Castle County and in accordance with State of Delaware Fire Marshall regulations for fire alarm detection signaling systems unless otherwise stated. If any FM200 would release as a result of the vendor's negligence, the vendor shall bear the cost of gas replacement. New Castle County will bear the cost if any FM200 is released due to an actual event. Question Deadline; 3pm on December 28th, 2023, Questions concerning the project should be submitted in writing via email to Frank Penta at frank.j.penta@newcastlede.gov Pursuant to New Castle County Code and Delaware Law, each bidder must submit proof satisfactory to the County or its designated representative that the bidder and every subcontractor possesses valid and effective licenses required by the United States, State of Delaware, County and any applicable political subdivision in which the project is located to do business within each such jurisdiction and to perform the labor and/or supply the materials involved in the performance of the contract. No contract will be executed prior to the submission of such proof and the acceptance thereof by the County or its designated representative. Awards, if any, will be made in conjunction with the Delaware Code, Subchapter 2, Chapter 69, Title 29, and the New Castle County Code Vendor shall purchase: (1) motor vehicle liability coverage, for owned, hired and non-owned vehicles, covering any and all claims for bodily injury and property damage that arise out of Vendor's performance of work for New Castle County, (2) comprehensive Commercial General Liability (CGL) insurance with limits of no less than $1,000,000 each occurrence and $2,000,000 annual aggregate. The CGL policy shall be extended by endorsement or otherwise to also include (a) coverage for Contractual Liability assumed by Vendor, with defense provided in addition to and separate from policy limits for indemnities of the named insured, (b) coverage for Independent Contractor Liability providing coverage in connection with such portion of the Services being subcontracted prior to any of the Services being subcontracted, in accordance with the terms and conditions of this Agreement, (c) coverage for Broad Form Property Damage Liability, (d) coverage for Personal Injury and Advertiser's Liability, (e) products and completed operations. Vendor will quote price for seventeen (17) months which will align with the end of New Castle County's 2025 fiscal year, with the option to renew annually for 12-month periods for four (4) additional years. If no agreement can be reached by either parties during the renewal, New Castle County reserves the right to rebid. Service, however, shall be maintained by the vendor at current price until a replacement system and/or vendor is obtained, and the system is operational. New Castle County reserves the right to add or delete locations.
