The City of Moreno Valley, (City) invites and will receive sealed Bids for the furnishing of all labor, equipment, materials, tools, services, transportation, permits, utilities, and all other items necessary for John F. Kennedy Veterans Memorial Park Playground Replacement - Project 807 0060. Each Bid shall be accompanied by cash, a certified or cashiers check, or Bid Bond secured from a surety company satisfactory to the City, the amount of which shall not be less than ten percent (10%) of the submitted Total Bid Price, made payable to the City of Moreno Valley to guarantee the Bidder will enter into a Contract with the City All questions, technical, commercial, or contractual in nature shall be directed to the Q&A section on the e-Procurement System. No phone calls will be allowed. Contact of City personnel directly regarding this solicitation is prohibited and may be grounds for elimination from the selection process. All questions regarding this solicitation must be submitted through Electronically no later than Monday, December 4, 2023 at 2:00 PM. The City will only consider bids that have been transmitted successfully and have been issued an ebid confirmation number with a time stamp from the Bid Management System indicating that the bid was submitted successfully. Transmission of bids by any other means will not be accepted. Bidders shall be solely responsible for informing themselves with respect to the proper utilization of the bid management system, for ensuring the capability of their computer system to upload the required documents, and for the stability of their internet service. Failure of the Bidders to successfully submit electronic bids shall be at the bidders sole risk and no relief will be given for late and/or improperly submitted bids. Bidders experiencing any technical difficulties with the bid submission process may contact Electronic Portal at (650) 336-7167 or utilize the chat bubble in the system. Neither the City, nor Electronic Portal, makes any guarantee as to the timely availability of assistance, or assurance that any given problem will be resolved by the bid submission deadline. Bid Value: $120,000 In the event that the successful Bidder withdraws its Bid prior to the expiration of sixty (60) Calendar Days after the Bid Submission Deadline, or attempts to withdraw its Bid when the requirements of Public Contract Code 5100 et seq. are not met, or refuses or fails to execute the Contract and provide the required bonds and insurance within ten (10) Working Days after award of the Contract, the Bid Security shall be retained by the City. In such event, the City may award the Contract for the Work to a responsible Bidder submitting the next lowest responsive Bid or may call for new Bids at the Citys sole discretion. Pursuant to Public Contract Code Section 20174, if the Contract is awarded to the next lowest responsible Bidder, the defaulted Bidder's Bid Security shall be used to cover the difference between the lowest Bid Price and the second lowest Bid Price, and any surplus will be returned to the defaulted Bidder or surety. The Contractor shall complete all preconstruction requirements, ordering of materials, and construction of the Project within the Contract Time of sixty (60) Working Days for the Base Bid only, and up to N/A Working Days for Base Bid plus all Additive Alternate Bids after the date of commencement specified in the Notice to Proceed to Fulfill Preconstruction Requirements issued by the City. The Contractor shall furnish, to the satisfaction of the Engineer, all labor, materials, tools, equipment, and incidentals, unless otherwise specified, to construct and complete the Work in compliance with the Contract Documents. Description of Work The work to be done consists of furnishing all labor, materials, delivery services, necessary tools and machinery, supervision and coordination, required for the removal and disposal of existing playground equipment including footings and wood chips playground surfacing, and installation of new playground equipment and engineered wood fiber playground surfacing system at John F. Kennedy Veterans Memorial Park as included in the Exhibits, Specifications and listed in the Bid Schedule. The City will purchase the playground equipment and will be delivered to the Citys Corporate Yard. Special Work Schedule within Park Vicinity The Contractor shall pay special attention to park activities and event schedules and shall coordinate with the Parks and Community Services Department (951-413-3280) to ensure that all work in the parks is scheduled to occur when there are not any park planned events to avoid conflicts. There are always activities in Sunnymead Park every day of the week, and its parking lot is used daily by park patrons. The Contractor shall have the work occur in stages and section by section so that the parking lot is always partially open for patrons. Full compensation for compliance with the preceding requirements shall be considered as being included in various contract work item within the bid schedule, and no additional compensation will be allowed therefor. The work to be done consists of furnishing all labor, materials, delivery services, necessary tools and machinery, supervision and coordination, required for the removal and disposal of existing playground equipment including footings and wood chip surfacing system and installation of new playground equipment and engineered wood fiber playground surfacing system at John F. Kennedy Park as included in the Exhibits, Specifications, and listed in the Bid Schedule. The City will purchase the playground equipment and will be delivered to the City Corporate Yard. Question Submission Deadline:December 4, 2023, 2:00 pm The successful Bidder will be required to furnish a Faithful Performance Bond and a Labor and Material Payment Bond each in an amount equal to one hundred percent (100%) of the Contract Price. Each bond shall be in the forms set forth herein, shall be secured from a surety company that meets all State of California bonding requirements, as defined in California Code of Civil Procedure Section 995.120, and that is a California admitted surety insurer. Moreno Valley was incorporated in 1984 as a General Law City, merging the communities of Moreno, Sunnymead and Edgemont. The City operates under a Council-Manager form of government. The City Council is comprised of an elected Mayor and four Council Members elected by district. The City has a committed customer-service oriented workforce comprised of more than 450 employees who provide a wide-range of municipal services including Public Works, Economic Development, Community Development, Parks and Community Services, Financial and Management Services and Library services. The City contracts with Riverside County for Police and Fire services. The successful Bidder shall perform, with its own organization, Contract Work amounting to at least 50 percent (50%) of the Contract Price, except that any designated Specialty Items may be performed by subcontract and the amount of any such Specialty Items may be deducted from the Contract Sum before computing the amount of Work required to be performed by the Contractor. The City reserves the right, in its sole discretion, to: judge the Bidders representations as stated in the Bid forms, including the Contractors Statement, and any post-Bid information to determine whether or not Bidder is qualified to perform the Work; be the sole judge regarding the suitability of the products, services or supplies offered; to not purchase all items or the full quantity of each item listed in the Contract documents; accept or reject any or all Bids; modify, cancel or withdraw the Notice Inviting Bids; issue a new Notice Inviting Bids; suspend or abandon the Project; appoint evaluation committees to review bids; and seek the assistance of outside technical experts in Bid evaluation; waive deficiencies, informalities and minor irregularities in any Bid or in the bidding process; require a Bidder to provide a guarantee (or guarantees) of the Contract by a third party; and/or not issue a Notice to Proceed after execution of the Contract. In submitting a Bid in response to the Notice Inviting Bids, the Bidder is specifically acknowledging the City holds these rights. The Notice Inviting Bids does not commit the City to enter into a Contract, to reject, in its sole discretion, all Bids, nor does it obligate the City to pay for any costs incurred in preparation and submission of a Bid or in anticipation of a contract. By submitting a Bid, the Bidder disclaims any right to be paid for such costs. Bids shall remain open and valid for 60 days after the Bid Submission Deadline. Bids may be withdrawn electronically on the OpenGov Vendor Portal prior to the Bid Submission Deadline. No bid may be withdrawn or changed after the Bid Submission Deadline, except as otherwise provided by law. The lowest Bidder may only request relief of its Bid in accordance with Public Contract Code Section 5100 et seq. Each Bidder agrees by submitting a Bid that its Bid shall remain open, is irrevocable, and may not be modified, withdrawn, or cancelled for a period of at least sixty (60) Calendar Days after Bid Submission Deadline.
