SCOPE OF WORK The City of Fond du Lac, Wisconsin is soliciting proposal for services to provide locating and marking of underground facilities. Upon receipt and review of the proposals, the City intends to enter into an exclusive contractual agreement for such services, and have accurate utility marking completed in response to all One-Call Notification Systems. The current One-Call Notification System operating in the City of Fond du Lac is Diggers Hotline, Inc. Under the service agreement, the contractor will be responsible for marking facilities owned and maintained by the following departments: City of Fond du Lac Sanitary & Storm Sewer - sanitary and storm sewer systems including laterals within the City right-of-way and/or easement. City of Fond du Lac Water Utility - water distribution network including laterals within the City right-of way and/or easement. City of Fond du Lac Information Technology Services (ITS) - fiber optic cable. Scope Locating Service Area: Underground facilities owned and maintained by ITS, the Electrical Division, and Storm Sewer System are located exclusively within the corporate limits of the City of Fond du Lac. Underground facilities owned and maintained by the Water Utility are primarily located within the City. However, wells and transmission mains are also located in the Towns of Fond du Lac and Byron. Underground facilities owned and maintained by the City for Sanitary Sewer System are primarily located within the City. However, some mains are also located in the Towns of Fond du Lac and Empire. Proposal Certification The Proposer must certify in writing that all Proposer's Proposal terms, including prices, will remain in effect for a minimum of 60 days after the Proposal Due Date, that all proposed capabilities can be demonstrated by the Proposer, and that the proposed hardware and system software is currently marketed and sold. Term of Contract The term of this agreement shall run from the date of award, estimated to be January 1, 2024, and remain in effect until December 31, 2026. The contract automatically renews for a one year period on the anniversary of the initial effective dates, unless sooner terminated by either party. Either party may terminate the agreement upon providing a written notice of ninety (90) days from the terminating party to the non-terminating party. Insurance Requirements The Contractor shall not commence work under this Contract until he has obtained all insurance required under this heading, nor shall any Contractor allow a subcontractor to commence work on his subcontract until the same insurance has been obtained by the subcontractor. Certificates of insurance on all policies specified shall be filed with the City Risk Manager prior to commencement of work. All insurance premiums shall be the obligation of and shall be paid by the Contractor. Withdrawal of Proposals Proposers may withdraw a Proposal which has been submitted at any time up to the Proposal closing date and time. To accomplish this, a written request signed by an authorized representative of the Proposer must be submitted to the Deputy Procurement Officer. After withdrawing a previously submitted Proposal, the Proposer may submit another Proposal at any time up to the Proposal closing date and time. Proposal Rejection The City of Fond du Lac reserves the right to reject any or all Proposals at any time without penalty.
