Pursuant to NC General Statute 143-129, sealed bids will be received by the Town of Apex for the furnishing of all materials and construction of a portion of the Reedy Branch Greenway (Sweetwater Gap), consisting of one contract having the following principal items: A. CONCRETE GREENWAY TRAIL B. DESIGN, PERMITTING AND CONSTRUCTION OF BOARDWALK C. EROSION CONTROL & GRADING The OWNER reserves the right to waive any informality, to reject any and all BIDS, and to award a contract which, in its judgment, is in the best interest of the Town of Apex. The BIDDER to whom a contract may be awarded shall fully comply with the requirements of all North Carolina General Statutes governing the practice of general contracting and the procedures for letting of public contracts. Bidder shall identify on the bid the minority businesses that will be utilized on the Project with corresponding total dollar value of the bid and affidavit listing good faith efforts or an affidavit indicating work under contract will be self-performed, as required by the Guidelines For Recruitment And Selection Of Minority Businesses For Participation In Town Of Apex Reedy Branch Greenway (Sweetwater Gap) Project. Value: $250,000 to $500,000 *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document. The Contractor agrees to provide all materials, equipment, machinery, tools, apparatus, power, sanitary facilities, water, means of transportation, incidentals, and labor necessary for the proper and lawful construction of the Reedy Branch Greenway (Sweetwater Gap), located at the Sweetwater Subdivision, Apex, NC. Materials shall be new and of the quality specified. Construction shall include, but not necessarily be limited to, the following: A. Concrete Greenway Trail B. Fencing C. Retaining Walls D. Boardwalks E. Bridges F. Erosion Control & Grading G. Storm Drainage H. Miscellaneous Concrete Said construction will be performed in accordance with the "Contract Documents." The term "Contract Documents" includes this Contract and the following which are hereby incorporated into this Contract as if fully contained herein: A.
