Each Bid shall be accompanied by a certified check, cashier's check, or Bid Bond, in the amount of five percent (5%) of the total amount of the Bid. Bid Guarantees for the three (3) low Bidders will be held until the Contract is executed. All other Bid Guarantees will be returned within seven (7) days of the bid opening. Power-of-Attorney for the person signing the Bid Bond for the Surety must be submitted with the Bid Bond. If the amount of the contract is $100,000 or more, the successful Bidder shall furnish the Engineer a Performance and Payment Bond each in the full amount of the Contract and shall maintain the Bond in force during the continuance of this Contract including the one year (1) warranty period. For projects less than $100,000, the requirement for Performance and Payment Bond is deleted. The Bond shall be for the faithful performance of this Contract in all respects including, but not limited to, payments for all materials and labor. All alterations, extensions of time, additional Work and other changes authorized by the Contract Documents may be made without securing the consent of the Surety or Sureties. The bond shall be with a good and sufficient corporate surety acceptable to the City and a Power-of-Attorney for the person signing the Bond for the Surety must be submitted with the Bond. Deadline for all questions is January 15, 2024 at 2:00pm. The City reserves the right to waive any irregularities or informalities in a bid and to reject any and all bids without cause.
