The Project generally consists of beach grass installation along the southernmost 10- mile length along the oceanfront, spanning between Bonnett St. and the Town southern corporate limits in Nags Head, NC. Bids will be received for a single prime Contract. Bids shall be on a unit price basis, based upon the estimated quantities noted on the bid form. If the Contractor's bid is greater than a total sum of $500,000.00 based on advertised quantities, in accordance with N.C.G.S. 143-129(b); 143-132 the Bid must be accompanied by Bid security made payable to Owner in an amount of 5% percent of Bidder's maximum Bid price (determined by adding the base bid and all alternates) and in the form of a certified check, bank money order, or a Bid bond (on the form included in the Bidding Documents) issued by a surety meeting the requirements of the General Conditions. The bid deposit/bond must accompany the bid at the time the bid is filed. Owner reserves the right to reject any or all Bids, including without limitation the rights to reject any or all nonconforming, nonresponsive, unbalanced, or conditional Bids, and to reject the Bid of any Bidder if Owner believes that it would not be in the best interest of Owner to make an award to that Bidder. After determination of the Successful Bidder based on this comparative process and on the responsiveness, responsibility, and other factors, the award may be made to said Successful Bidder on its Base Bid and any combination of its additive alternate Bids for which Owner determines funds will be available at the time of award and in the interest of the Town of Nags Head. Owner also reserves the right to waive informalities or minor defects and to reject any or all bids. The bidder to whom this project is awarded shall have until March 30, 2024 to Substantially Complete the Project. Other provisions as to time of Full Completion, project milestones, Liquidated Damages, etc. are set forth in the Contract Documents. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less than seven (7) days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. The number of days within which, or the dates by which, the Work is to be substantially completed, and completed and ready for final payment, are set forth in the Service Contract "Agreement". Provisions for liquidated damages, if any, for failure to timely attain a Milestone, Substantial Completion, or completion of the Work in readiness for final payment, are set forth in the Agreement.
