The City of Pismo Beach (CITY) is inviting sealed proposals for the manufacture and delivery of an Ultraviolet Disinfection Advanced Oxidation Process System (System), and provision of related services, all as more fully described herein, for the Central Coast Blue Project. The selected proposer will be required to work closely with CITY staff to manufacture and deliver the System, together with certain installation instructions and specifications, for the Central Coast Blue Project. The System will be installed by other contractor(s) at a new Advanced Water Purification Facility planned for construction, at 980 Huber Street, Grover Beach, CA 93433. Any System proposed to be provided and delivered shall be subject to all warranties set forth herein including, but not limited to, a warranty against defects in design and manufacturing, and a warranty of life cycle cost. The scope of work generally consists of manufacturing and delivering a turn-key Ultraviolet Disinfection Advanced Oxidation Process (UV-AOP) System ("System" sometimes herein) for the Central Coast Blue Project. The scope of work also includes provision of all engineering documents and specifications necessary for the CITY's installation contractor to fully and completely install the System once delivered to and accepted by the CITY. A detailed description of the scope of work can be found in the Technical Specifications attached hereto as Exhibit "F". NOTE: The CITY intends to assign the contract for purchase and delivery of the System resulting from this RFP, if one is entered, prior to shipment, to the contractor selected by the CITY to install the System at the AWPF. Thereafter, this "installation contractor" will assume all of the CITY's obligations under the System purchase and delivery contract. All proposals will be evaluated on the basis of life cycle cost as described in the Proposal Form attached hereto as Exhibit "A". Only those timely submitted proposals meeting the requirements of this RFP and executed by an authorized company officer will be considered. Untimely received proposals will be disregarded. Any proposer mailing or otherwise not personally delivering their proposal bears all risk of untimely delivery or non-delivery. Any proposal may be withdrawn by written request of the proposer, received prior to the Proposal Deadline. Any changes, additions, or deletions to this RFP will be in the form of written addenda issued by the CITY. Any addenda will be posted electronically. Prospective proposers must check electronically for addenda or other relevant new information during the response period. The CITY is not responsible for the failure of any proposer to receive such addenda. All addenda so issued shall become a part of this Request for Proposals. Any proposer mailing or otherwise not personally delivering their proposal bears all risk of untimely delivery or non-delivery. REQUEST FOR PROPOSALS FOR UV-AOP SYSTEM iii Any proposal may be withdrawn by written request of the proposer, received prior to the Proposal Deadline. Any changes, additions, or deletions to this RFP will be in the form of written addenda issued by the CITY. Any addenda will be posted on the CITY's website where the RFP is posted ("Project Website"). Prospective proposers must check the website for addenda or other relevant new information during the response period. The CITY is not responsible for the failure of any proposer to receive such addenda. All addenda so issued shall become a part of this Request for Proposals. Since the Project will be funded in whole or in part by a loan from the United States Environmental Protection Agency (USEPA) Water Infrastructure Finance and Innovation Act (WIFIA), and with grantsfrom the United States Bureau of Reclamation (USBR) WaterSMART Title XVI Program, the State Water Resources Control Board (SWRCB) Water Recycling Funding Program, the SWRCB Proposition 1 Groundwater Grant Program, and State Department of Water Resources Proposition 1 Integrated Regional Water Management Program the work must also comply with the minimum rates for wages for craftworkers as determined by the U.S. Secretary of Labor in accordance with the provisions of the Davis-Bacon Act. As between the State and federal wage rates, to the extent both rates apply to any portion of the work, the higher of the two rates must be paid on work that constitutes "public works." Attention is directed to the USBR Funding Requirements Supplements to this RFP. In submitting a proposal for this Project, it shall be the proposer's sole responsibility to evaluate and include the cost of complying with all federal and State labor requirements, terms and conditions of all funding agencies referenced and incorporated herein, and any and all other applicable regulations, statutes, orders, and laws, in their proposal. Proposer shall be required to agree to submit such reasonable assurances and execute such certifications as may be required by agencies providing funding to the City for the Project. Before any contract is awarded, the successful proposer will be required to provide proof of proposer current DIR registration. Each proposer must have a valid business license and/or tax certificate before beginning the work. Additional information regarding the CITY's business license program may be obtained by calling (805) 773-4655. Each proposal shall be accompanied by cash, a certified or cashier's check payable to the CITY, or a satisfactory "bid bond" in favor of the CITY executed by the successful proposer as principal and an admitted surety insurer as Surety, in an amount not less than ten percent (10%) of the amount set forth in the proposal. The cash, check or Bid Bond shall be given as a guarantee that, if selected, the successful proposer will execute the CITY's contract in conformity with the Contract Documents, and will provide the evidence of insurance and furnish the performance and payment bond, if required, within fifteen (15) calendar days after the date of delivery of the Contract Documents to the successful proposer. In case of the proposer's refusal or failure to do so, the CITY may award the contract to the next, highest ranked proposer, and the cash, check, or Bond (as applicable) of the original, selected proposer shall be forfeited to the CITY to the extent permitted by law. No Bid Bond will be accepted unless it conforms substantially to the form provided in the Contract Documents. Bid securities will be returned to unsuccessful proposers, or if all proposals are rejected, a proposal is timely withdrawn, or if this RFP process is terminated. Each proposer bears any and all costs and expenses incurred in the preparation of their proposal. The CITY reserves the right to: reject any or all proposals, waive any errors, omissions, informalities and minor irregularities in this RFP process and/or in any proposal; terminate this RFP process; not award a contract for any reason. PROPOSALS ARE PUBLIC RECORDS. All proposals once submitted shall become the property of the CITY, public records and subject to disclosure as such. However, no proposal will be disclosed prior to (a) selection of a proposer and written recommendation for selection of the proposer being made to CITY's City Council; (b) rejection of all proposals; or, (c) termination of this RFP process. NOTE: Notices of confidentiality, "proprietary information", "trade secrets", or any similar kinds of non-disclosure notices, will be disregarded. DO NOT SUBMIT CONFIDENTIAL INFORMATION. The CITY anticipates awarding a contract for the manufacture and delivery of the System, if one is awarded, by February 20, 2024. After a written notice to proceed is issued by the CITY directing the proposer to commence performance of specified work ("Notice to Proceed"), the proposer's work shall begin immediately. The actual start date and completion of the services rendered will depend on the actual date CITY issues its Notice to Proceed. The Notice to Proceed issued by the CITY will specify the work to be completed, and a schedule for work completion. The basis for payment and the limits of compensation shall be integrated within the Agreement. The proposer shall not begin work nor incur any costs associated with any task identified herein without prior to receipt of a Notice to Proceed.
