Site work and new construction of a water / sewer project in Fargo, North Dakota. Completed plans call civil work for a water / sewer project.

This project is for the reconstruction of storm sewer lift station #27 located on 32nd Avenue South east of 11th Street. An earthen levee will also be constructed east of the YWCA building located at 1101 32nd Avenue South. This Project is using SRF Loan Funds and Federal Funds and there are additional terms and conditions required to comply with the contract specifications. Please confirm all requirements are met and documents are included with your bid. This Project will comply with SRF and Federal requirements. In the event of a discrepancy between City of Fargo contracting requirements and SRF and Federal contracting requirements, the SRF and Federal contracting requirements shall prevail. All work included in the contract must be fully completed on or before May 30, 2025. A BIDDER'S BOND IN THE AMOUNT OF 5% OF THE FULL AMOUNT OF THE BID executed by the bidder as principal and by a surety, conditioned that if the principal's bid is accepted and the contract awarded to the principal, the principal, within 10 days after notice of award, shall execute a contract in accordance with the terms of the bid and a contractor's bond as required by law and the regulations and determinations of the governing body. Countersignature of a bid bond is not required under this section. All bidders, except a bidder on a municipal, rural, and industrial water supply project authorized for funding under Public Law No. 99-294 [100 Stat. 426; 43 U.S.C. 390a], must be licensed for the full amount of the bid, as required by N. D. Cent. Code Section 43-07-07. Bidder must be the holder of a Contractor's License at least ten days before the date set for receiving bids to be a qualified bidder and a copy of the Contractor's License issued by the Secretary of State must be included in the online bid submission as required under N. D. Cent. Code Section 43-07-12. Each bid shall be accompanied by bidder's completed (i) MBE/WBE Subcontractor Solicitation Information Form; (ii) Certification regarding Debarment, Suspension, and other Responsibilities Form; (iii) DBE Subcontractor Utilization Form, and (iv) DBE Subcontractor Performance Form. No bid will be opened, read or considered if the bidder does not submit the required (1) Bid Bond; (2) Contractor's license; (3) MBE/WBE Form; (4) Debarment Form; (5) DBE Subcontractor Utilization Form; (6) DBE Subcontractor Performance Form; and (7) Acknowledgment of Addenda (One or more). Bidders on this work will be required to comply with American Iron and Steel requirements of the Consolidated Appropriations Act, 2014. The requirements for bidders and contractors under this regulation are explained in the specifications. Bidders are required to comply with Davis-Bacon prevailing wage requirements. All bidders should be advised that if awarded, the Contractor shall comply with the (i) American Iron and Steel requirements; (ii) Civil Rights requirements; (iii) Equal Employment Opportunity requirements; (iv) create an affirmative action plan; (v) provide evidence of compliance with the Disadvantaged Business Enterprises (DBE) participation; (vi) and provide evidence of compliance with the Davis Bacon Act as more fully set forth in the Contract. Bidders on this work will be required to comply with Title 40 CFR Part 33 - Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women's Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications. The goal for MBE is 2% of the total dollar value of the project. The goal for WBE is 3% of the total dollar value of the project. To demonstrate a good faith effort to comply, bidders must include the MBE/WBE subcontractor solicitation form in the bid package. The Board of City Commissioners of the City of Fargo, North Dakota, reserves the right to hold all bids for a period of thirty days after the first day fixed for the opening of the bids, and the right to reject any or all bids and to waive any formalities. Questions concerning the Proposal must be made in writing at least forty-eight (48) hours in advance of the time set for bid opening, exclusive of Sundays and legal holidays. The City Engineer will respond in writing to all inquiries twenty (20) hours before the time set for bid opening to all Bidders or Contractors obtaining Contract documents. In no event will questions be answered if made within twenty-four (24) hours prior to bid opening.
