This Project is subject to labor compliance monitoring and enforcement by the Department of Industrial Relations pursuant to Labor Code section 1771.4 and subject to the requirements of Title 8 of the California Code of Regulations. The successful Bidder shall comply with all requirements of Division 2, Part 7, Chapter 1, Articles 1-5 of the Labor Code. Liquidated Damages Time is of the essence for all work under this Agreement. It is hereby understood and agreed that it is and will be difficult and/or impossible to ascertain and determine the actual damage that the District will sustain in the event of and by reason of Contractor's delay; therefore, Contractor agrees that it shall pay to the District the sum of Thirty-Five Thousand and No/100 dollars ($3,500) per day as liquidated damages for each and every day's delay beyond the time herein prescribed in completion of the Work. The Board reserves the right to reject any and all bids and/or waive any irregularity in any bid received. If the District awards the Contract, the security of unsuccessful bidder(s) shall be returned within sixty (60) days from the time the award is made. Unless otherwise required by law, no bidder may withdraw its bid for ninety (90) days after the date of the bid opening. SCOPE OF WORK. a. Acknowledged Receipt of Addenda. b. Are the costs for addenda items included in your bid (if applicable). c. Do you have a complete understanding of your Scope of Work under the proposed Agreement. d. You have re-reviewed the documents and understand the Scope of the Work. Are there any items that require clarification Yes No If yes, please identify them. Engineer's estimate is $6,000,000. The Project consists of but not limited to. 1. Demolition of existing varsity baseball and softball fields. Work to include but not limited to demolition of irrigation, landscaping, existing dugout structures, concrete, fencing, netting, and foundations in their entirety. 2. Site work scope of work shall include rough grading, installation of irrigation, underground utility lines including domestic water, electrical, and low voltage conduit. 3. Construction of new varsity baseball field & varsity softball field including fields, backstop, dugouts, bullpens, & batting cages. 4. Installation of (3) 5 row bleachers at both varsity baseball and varsity softball fields 5. New tennis courts at new location 6. Site work related to all paving areas along accessible path of travel. 7. New pc-scoreboard at each field location 8. New pc-shade structures at each new and existing batting cages All bids shall be on the form provided by the District. Each bid must conform and be responsive to all pertinent Contract Documents, including, but not limited to, the Instructions to Bidder A bid bond by an admitted surety insurer on the form provided by the District a cashier's check or a certified check, drawn to the order of the Sacramento City Unified School District, in the amount of ten percent (10%) of the total bid price, shall accompany the Bid Form and Proposal, as a guarantee that the Bidder will, within seven (7) calendar days after the date of the Notice of Award, enter into a contract with the District for the performance of the services as stipulated in the bid. The successful Bidder shall be required to furnish a 100% Performance Bond and a 100% Payment Bond if it is awarded the Contract for the Work.
