Renovation of an educational facility in Home, Pennsylvania. Completed plans call for the renovation of a educational facility.
Bids shall include a Bid Security Bond or Certified Check, payable to Marion Center Area School District, in an amount of five percent (5%) of the bid, in accordance with Instructions to Bidders, as included in the Contract Documents. The Marion Center Area School District will receive bids for Air Conditioning for Rayne Elementary School, 2535 Route 119 Hwy, Home, PA 15747. It is the intent of the Owner to enter into separate contracts as follows: Contract No. 1 HVAC Construction Contract No. 2 Electrical Construction Such Bid Bond or Check shall be submitted with the understanding that it shall guarantee that the Bidder's Bid will not be withdrawn for a period of at least sixty (60) days after the scheduled closing time for receipt of bids; that if the Bid is accepted, the Bidder will execute the Form of Agreement, as provided by the Owner, with all blanks appropriately filled and will submit the required 100% Performance and Labor and Material Bonds (submitted on A.I.A. Document A312) and 100% Maintenance Bond as specified in Section 007216, Article 11; and that in the event of withdrawal of said Bid within said period, or the failure to enter into said Agreement and submit said Bonds within ten days after the Bidder has received notice of the acceptance of the Bid, the Bidder shall be liable to the above mentioned Owner for the full amount of such Bond or Check as representing the damage to the Owner on account of the default of the Bidder in any particular hereof. The Bid Bond or Check of all Bidders whose Bids are not accepted will be returned within ten calendar days after the scheduled bid opening date. 1. Contractor's withdrawal of Bid: a. A bidder may only withdraw a bid if there is an honest and good-faith mistake (which must be supported by evidence) in the calculation of the bid price. A bidder has two business days from bid opening to withdraw a bid. b. The Owner reserves the right to accept or decline the Contractor's Withdrawal of Bid Request and reserves the right to retain the bid bond. c. A bidder who withdraws a bid will not be permitted to bid on the project a second time (should it be rebid) or provide any work or materials to the project. d. If the Owner chooses to rebid the project, the bid bond of the withdrawing bidder will be forfeited to the Owner to supplement the rebid costs. B. The Owner shall have the right to accept Alternates in any order or combination and to determine the low Bidder on the basis of the sum of the Base Bid and Alternates accepted on the date of Contract Award. C. The Owner reserves the right to waive any informality in bids when such waiver is in the interest of the Owner. D. The Owner reserves the right to reject any and all bids when such rejection is in the interest of the Owner, and to reject the bid of any Bidder, who in the Owner's judgment, is not in position to perform the Contract. E. Each Bidder agrees to waive any claim it has or may have against the Owner, the Architect/Engineer, and their respective employees, arising out of or in connection with the administration, evaluation, or recommendation of any bid.
