PURPOSE: The goal of the Lake Anna Cyanobacteria Mitigation and Remediation Program ("the Program") is to achieve a safe and naturally balanced phytoplankton biomass in the three Lake Anna tributaries. This goal will be met through achievement of the two objectives outlined below: 1) Objective 1: Reduce and sustain total phosphorus levels at all monitoring stations in the three Lake Anna tributaries below 30 micrograms per liter (ug/L) (also measured as parts per billion (ppb)). 2) Objective 2: Reduce and sustain total potentially toxic (PTOX) cyanobacteria cell counts at all monitoring stations in the three Lake Anna tributaries below 50,000 PTOX cyanobacteria cells per milliliter. This level is 50% of the current VDH recreational advisory threshold. Interested parties ("Contractors" or "Offerors") are invited to submit proposals for the Lake Anna Cyanobacteria Mitigation and Remediation Program. The Scope of Work for the Lake Anna Cyanobacteria Mitigation and Remediation Program is described in Section IV of this RFP. The Statement of Work for the Lake Anna Cyanobacteria Mitigation and Remediation Program is outlined in Section V of this RFP. For the purposes of this RFP, the terms "mitigation" and "remediation" are used to describe physical, biological, or chemical methods that either directly or indirectly reduce phosphorus levels and PTOX cyanobacteria cell counts. SCOPE OF WORK: All work efforts executed under the Program will be accomplished in the three main Lake Anna tributaries and the watersheds that feed each of these tributaries. The Program consists of five (5) phases with contract base and option years assigned to each phase. 1) Phase 1 of the Program will be executed during the base year of any contracts awarded as a result of this RFP. Phase 1 includes a limited scope effort focused on the upper 865 acres of the North Anna tributary (see map at Attachment 4). 2) Phase 2 of the Program will be executed during option year 1 of any contracts awarded as a result of this RFP. The scope of Phase 2 includes all seven segments making up the three Lake Anna tributaries. This phase continues work initiated in Phase 1 and extends work efforts to the rest of the North Anna tributary and the other two Lake Anna tributaries (Pamunkey Creek and Terry's Run). 3) Phase 3 of the Program will be executed during option year 2 of any contracts awarded as a result of this RFP. The scope of Phase 3 includes all seven segments making up the three Lake Anna tributaries. This phase continues work initiated in Phases 1 and 2. 4) Phase 4 of the Program will be executed during option year 3 of any contracts awarded as a result of this RFP. The scope of Phase 4 includes all seven segments making up the three Lake Anna tributaries. This phase continues work initiated in Phases 1, 2, and 3. 5) Phase 5 of the Program will be executed during option year 4 of any contracts awarded as a result of this RFP. The scope of Phase 5 includes all seven segments making up the three Lake Anna tributaries. This phase completes work initiated in Phases 1, 2, 3, and 4. The three Lake Anna tributaries are approximately 3,700 acres in lake surface area. Lake depth varies across the three Lake Anna tributaries from less than 1 meter (m) to 15.5m when the reservoir is at normal level. "Normal" reservoir level is defined as 76.2m Mean Sea Level (MSL) or 250 feet. The total Lake Anna watershed is 218,500 acres in size. The watersheds feeding the three Lake Anna tributaries is approximately 163,000 acres in size. Proposals shall remain valid for one hundred and eighty (180) calendar days after submission. Offeror's shall include a statement in their Proposal Cover Letter stating that their proposal remains valid for 180 calendar days after submission. b. The following documents must be received in the Louisa County office via hard copy AND electronic copy (emails are not permissible - please send an electronic version such as a CD or flash drive with your hard copy) no later than the closing date and time stated below (Note: a hard copy and electronic copy must both be received by the closing date. If one or the other is not received, your proposal will be deemed late and not be considered): 1. Your original proposal. 2. If applicable, include a redacted copy which does not include trade secrets or proprietary information. The RFP number and closing date must be clearly marked on the outside of the sealed envelope. Each sealed envelope containing a Proposal must be plainly marked on the outside as follows: Lake Anna Cyanobacteria Mitigation and Remediation Program, RFP# LAAC-24-01, Name of the Proposer, Address of the Proposer, A Statement reading "This container is not to be opened prior to the Due Date and Time." Should any Proposal be received which is not so identified, the proposer assumes the risk that the submission will be opened prior to the Proposal Due Date. Proposals so opened shall be disqualified. Termination and Cancellation: LAAC shall have the unilateral right to terminate any contract with Vendor for default on the terms of that contract, or any other contract between the Vendor and LAAC. LAAC has the unilateral right to cancel and terminate any contract with Vendor, in whole or in part, without penalty, merely out of convenience, and shall require no breach of contract by Vendor as a condition of termination. This right of termination for convenience may be exercised at the sole unconditional discretion of LAAC. If a contract is terminated in whole or in part for the convenience of LAAC, the Vendor shall be paid the contracted price for the service or goods actually provided or rendered up to the date of the termination of the respective contract, but shall not be paid any other fees or lost profits. Any contract cancellation notice shall not relieve the Vendor of the obligation to perform on all outstanding orders issued prior to the effective date of cancellation.
