No bid may be withdrawn for a period of sixty (60) days after the time of the opening of the bids. BIDDER'S SURETY -- A certified check made payable to the St. Marys Area Water Authority, or a Bid Bond on the Bid Form executed by the Bidder and a surety company approved by the OWNER, in an amount equal to ten percent (10%) of the total amount of bid, must be submitted with each bid or bids will be considered nonresponsive and immediately rejected. SUCCESSFUL BIDDING BIDDER awarded this Contract shall provide a performance surety in the amount of one hundred percent (100%) of the Contract Amount. All questions about the meaning or intent of the Contract Documents shall be submitted to ENGINEER in writing. Replies will be issued by Addenda mailed, faxed or delivered to all parties recorded as having received the Bidding Documents. Questions received less than five (5) days prior to the date of bid opening may not be answered.
