The Rural Municipality reserves the right to accept or reject any or all tenders and to waive irregularities and informalities at its discretion. The Rural Municipality reserves the right to accept other than the lowest tender without stating reasons. By the act of submitting its bid, the Bidder waives any right to contest in any legal proceeding or action the right of the Rural Municipality to award the good or service to whomever it chooses, in its sole and unfettered discretion, and for whatever reasons the Rural Municipality deems appropriate. Without limiting the generality of the foregoing, the Rural Municipality may consider any other factor besides price and capability to perform the work that is deems in its sole discretion to be relevant to its decision including but not limiting to the following: Previous experience the municipality has with the bidder; Experience that the bidder has in successfully completing similar projects. Project Specifications To be completed by October 31, 2024. Wobeser Pit- NW-20-52-08 W3: 15,000 yards of 7/8" crush - screening if required Bouchard Pit- NW-21-52-08 W3: 15,000 yards of 7/8" crush - no screening required, bailing is required Molzan Pit- NE/NW-01-54-05 W3: 10,000 yards of 7/8" crush - requires a minimum 24" jaw for large rock, if stripping required, take stripping to reclaim partial pit approximately 5 acres The R.M. will take random samples, at the cost of the R.M., to test for quality assurance. All amounts are approximate and dependent on availability of material in the pit. Adjustments may be made to have the total yardage (40,000) crushed throughout the pits. Final payment will be based on the actual measured stockpile BEFORE hauling commences. No allowance will be given for gravel compaction.
