and the Apparent Low Bidders will be automatically generated and posted for furnishing all plan, labor, material and equipment and performing all work required for the construction of Lost Creek Pump Station. The Site is located is north of the intersection of Nicholas Trail and Abigail Way in Fort Bend County, Texas. Reproduction charges will apply according to rates. The right is reserved, as the interest of the Owner may require, to accept or reject any or all bids, and to waive any informality in the bids received. Bids may be held for a period not-to-exceed sixty (60) days before awarding the contract(s). The Contractor hereby agrees to begin work within 10 calendar days after Engineer has given written Notice to Proceed. Contractor hereby also agrees to achieve Substantial Completion of the Work within 450 calendar days after the date of the written Notice to Proceed and to achieve Final Completion of the Work within 15 calendar days after the initial field inspection with the City of Missouri City and Fort Bend County (Engineering and Fire Marshall) for acceptance of the work has taken place. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Invitation for Bids is/are expected to be funded in part by a loan or grant from the Texas Water Development Board. Neither the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this Invitation for Bids or any resulting contract. Any contract(s) awarded under this Invitation for Bids is/are subject to the United States Iron and Steel requirements of Texas Water Code 17.183 and/or Texas Government Code, Chapter 2252, Subchapter F, as amended by SB 1289, 85th Legislative Session, as applicable. The contractor must complete the statement of understanding regarding this requirement, found in the Supplemental Contract Conditions, Item No. 9. Refer to TWDB-1105 - United States Iron and Steel (US I&S) Guidance. Each bidder shall furnish a bid guarantee equivalent to five percent of the bid price (Water Code 17.183). If a bid bond is provided, the Contractor shall utilize a surety company which is authorized to do business in Texas in accordance with Surety Bonds and Related Instruments, Chapter 3503 of the Insurance Code. A governmental entity may not award a governmental contract to a nonresident bidder unless the nonresident underbids the lowest bid submitted by a responsible resident bidder by an amount that is not less than the amount by which a resident bidder would be required to underbid the nonresident bidder to obtain a comparable contract in the state in which the nonresident's principal place of business is located. A nonresident bidder is a Contractor whose corporate offices or principal place of business is outside of the state of Texas (Source: Texas Government Code, Chapter 2252, Subchapter A, Nonresident Bidders, 2252.002). The bidder will complete form TWDB-0459, Vender Compliance with Reciprocity on Nonresident Bidders, which must be submitted with the bid. JOB NO.: 2021239-000-00-102
