Each Proposer shall be responsible for reviewing and submitting the Submission Certification Form which includes a list of all documents required to be submitted to the City for consideration. Verbal explanations or instructions given during any phase of this solicitation will not be binding. Any information given to a prospective firm concerning this solicitation will be furnished promptly to all prospective firms as an addendum to this solicitation, if that information is necessary in submitting proposals or if the lack of it would be prejudicial to other prospective proposers. The City of Victorville reserves the right to accept or reject any and all proposals and to award Consultant/Professional Services Provider Agreement(s) to the proposer(s) found to best meet the requirements to provide the requested services. Relevant factors which will be considered in evaluating the proposals are: qualifications and required certifications of key personnel; related projects on which key personnel have worked; completeness and accuracy of submission documents (including acknowledgement of any addenda to this RFQ issued by the City); past experiences with the City; and references from other cities, developers, or public agencies regarding past work and services provided. The City reserves the right to reject the proposal of any Proposer who previously failed to perform adequately for the City or any other governmental agency. Once Consultant/Professional Services Provider Agreement(s) are awarded to successful proposers, consultant services will be on an as-needed, on-call basis per project. Consultant services will be authorized by separate project agreements(s) or work authorization(s) which may take the form of City purchase orders or task orders, dependent upon the scope and nature of the work required. Projects may vary significantly in scope and will be determined in greater detail when a request for a quote is issued to the Consultant, although some on-call projects (e.g., work that is non-complex or of limited scope and duration) will not require requests for quotes. The Consultant will be responsible for preparing a detailed estimate in response to each request and shall identify the laboratory testing, number of hours, and position of each person performing work on the project. During a project, if actual costs are projected to exceed the amount authorized by any separate work authorization,, the Consultant shall notify the Project Manager as soon as possible before exceeding the estimated contract cost. The City may elect to reduce the scope of work or may require a revised scope of work to keep project costs within budget. Work authorization will be issued in a form to be determined by the City for each separate project. The City shall authorize all consultant quotes for projects prior to the Consultant commencing work. The City may accept the Consultant's scope and fee or negotiate with the Consultant, as appropriate. The City reserves the right to not accept the Consultant's scope and fee for any project quoted. The Consultant will not be allowed to provide services when a potential conflict of interest may exist. Selection will be based on demonstrated experience, expertise, and capability in providing support to the City. Consultants do not need to be able to provide all the services described in the Preliminary Scope of Services. This Request For Qualifications (RFQ) outlines the minimum qualifications, requirements, selection process, and documentation necessary to submit a responsive proposal package to the City. The selected Consultants will be required to enter into a Consultant Professional Services Agreement with the City. The compensation for services potentially to be provided by each Consultant will be no more than $125,000 per year over the initial two-year term, with an aggregate total contact amount of $500,000 if both one-year extensions are granted. All proposers shall be properly licensed for the performance of the Services in accordance with California law. Depending upon the City's workload, Consultants may or may not be called upon to provide services within the periods specified above. Consultants who have entered into an agreement with the City will receive a request for a quote to provide an estimated cost for individual projects for budgeting and funding the services. The projects may be discrete, short-term assignments or may be part of a larger public works project that could span weeks to months. Compensation for Consultant work will be established for each project at the time it is assigned after quotes are received and funding is secured.
