This is a contract for emergency response. The contractor is expected to provide goods and services in response to pandemics, floods, storms, fires, earthquakes, and other disasters. Although telecommunications services are not offered through this contract due to Section 2155.502(c)(2) and Chapter 2170 of the Government Code, it is anticipated that the Governor may, from time to time, suspend these statutes under the authority of Chapter 418 of the Government Code. Therefore, a state agency may purchase telecommunications services through this Contract only as necessary to protect life and property within the scope of a disaster declaration by the Governor. Otherwise, state agencies must purchase telecommunications services through the Department of Information Resources. It is the purchaser's responsibility to ensure only contracted items are purchased through this contract when purchasing offline. Prior to purchasing from a TXMAS contract, public procurement personnel must follow applicable procurement procedures as stated in the Procurement and Contract Management Guide. Agencies must first purchase products or services offered by WorkQuest, Texas Correctional Industries (TCI), and the Statewide Procurement Division (SPD) Term Contracts.
