No definite date for the rebid.** Please Indicate on the Outside of the Envelope the Following: Sealed Bid: Osage Beach City Park Pickleball Court. The Scope of Work includes construction of (2) new pickleball courts, (1) new parking lot, slope restoration on the site, fence installation around the pickleball courts, adding blocks to retaining wall, and other incidental items and work described in the Project Manual, or reasonably inferable therefrom. Bids must be submitted on the Bid Forms provided in the bound Bidding Documents Package and be accompanied by the bidder's certified check or bid bond in the amount of five percent (5%) of the total bid. A performance bond will be required of the successful bidder. The successful bidder will also be required to obtain a contractor's license and submit a certificate of insurance for workers' compensation. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof. Any Bidder or equipment supplier whose firm or affiliate is listed on the General Services Administration (GSA) publication entitled "Lists of Parties Excluded from Federal Procurement or Non-procurement Programs" will be prohibited from the bidding process. Anyone submitting a bid who is so listed will be determined to be a non-responsive Bidder in accordance with 40 CFR 31. Bidders on this work will be required to comply with the President's Executive Order No. 11246 in regard to non-discrimination in employment. Any Bidder or equipment supplier whose firm or affiliate is listed on the General Services Administration (GSA) publication entitled "Lists of Parties Excluded from Federal Procurement or Non-procurement Programs" will be prohibited from the bidding process. Safety training Bidders are informed that the Project is subject to the requirements of Section 292.675, RSMo, which requires all contractors or subcontractors doing work on the Project to provide, and require its on-site employees to complete, a ten (10) hour course in construction safety and health approved by the Occupational Safety and Health Administration ("OSHA") or a similar program approved by the Missouri Department of Labor and Industrial Relations which is at least as stringent as an approved OSHA program. The training must be completed within sixty (60) days of the date work on the Project commences. On-site employees found on the worksite without documentation of the required training shall have twenty (20) days to produce such documentation. Authorized employees Contractor acknowledges that Section 285.530 RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the state of Missouri. Contractor therefore covenants that it is not knowingly in violation of subsection 1 of Section 285.530 RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully eligible to work in the United States. All disputes under this contract and any litigation resulting under this contract shall be filed, tried, remain and be ultimately resolved in the Circuit Court of Camden or Miller County on any appeal therefrom within the courts of the State of Missouri. The contractor hereby knowingly, intelligently and voluntarily agrees and waives any and all removal rights to federal court or the right to litigate the claim or any part thereof in courts of any other state for any reason.
