The intent of the CONTRACT Documents is to prescribe a complete outline of the WORK which the CONTRACTOR undertakes to do in full compliance with the CONTRACT. He shall furnish all required materials, equipment, tools, labor, and incidentals, unless otherwise provided in the CONTRACT, and shall include the cost of these items in the unit prices BID for the several units of WORK. Trail Recreation Effingham County will receive bids for the furnishing of materials for the Phase Vl-C project, including 14,000 square feet of 10 wide concrete sidewalk, and miscellaneous items This project is being financed, in part, with federal funds from the Recreational Trails Program (RTP) administered by the Illinois Department of Natural Resources. Trail Recreation Effingham County encourages minority business firms to submit bids on the approved project. Trail Recreation Effingham County also encourages successful contract bidders to utilize minority businesses as subcontractors for supplies, equipment, services, and construction. This project is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budgets Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18,2022 A certified check or bank draft, payable to Trail Recreation Effingham County, negotiable U.S. Government bonds (at par value), or a satisfactory Bid Bond executed by the Bidder and an acceptable surety in an amount equal to five percent (5%) of the total bid shall be submitted with each bid. Attention is called to the fact that not less than the general prevailing rate of wages in Effingham County for each craft or type of worker needed to execute the contract or perform such work shall be paid. Also, the general prevailing rate of wages for legal holiday and overtime work, as ascertained by the Illinois Department of Labor, shall be paid for each craft or type of worker to execute the contract or to perform the work. Requirements for determining the prevailing wage rates are in the contract documents. The Contractor must ensure that employees and applicants for employment are not discriminated aqainst because of their race, color religion, sex, or national origin. Trail Recreation Effingham County reserves the right to reject any or all bids or to waive any informalities in the bidding. A Substance Abuse Policy and certificate of insurance shall be submitted before a contract is signed. Bids may be held by Trail Recreation Effingham County for a period not to exceed sixty (60) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of Bidders, prior to awarding the Contract.
