Bidding documents for the construction of said project have been prepared by the OWNER and are available for inspection at the Osage Nation Purchasing Department offices upon request. Prospective Bidders can obtain a copy of the bidding documents only from the Osage Nation Procurement Department. Bids received more than ninety-six (96) hours, excluding Saturdays, Sundays, and Holidays, before the deadline set for receiving bids, as well as bids received after the deadline set for receiving bids, will not be considered and will be returned to the Bidder unopened. Bidder shall include in the price bid for the project all appropriate local, state and federal sales taxes which are applicable to the construction of the project. A Cashier's Check, a Certified Check, or a Bidder's Bond, in the amount of five percent (5%) of the amount of the total proposed bid, shall accompany the sealed proposal of each Bidder and shall be retained by the OWNER as liquidated damages in the event the successful Bidder fails, neglects, or refuses to enter into the CONTRACT for the construction of said work, or fails to furnish the required bonds within ten (10) working days after the date the award is made. Bids will not be considered unless accompanied by said Cashier's Check, Certified Check or Bidder's Bond in the required amount and made payable to the Osage Nation. Bids and Affidavits must be submitted as originally provided in the bidding documents without alterations, additions, or erasures. Erroneous entries shall be lined-out and initialed by the Bidder. Each bid shall be filed in a manner consistent with the requirements found in the Instructions to Bidders. All bids shall be either typewritten or written in ink. The OWNER reserves the right to reject any and all bids received for this project. Bids will be publicly opened and examined for accuracy and completeness by the Osage Nation Procurement Officer at 11:10 a.m. at Osage Nation Roads Department Building, located at 1290 West Avenue In Pawhuska, OK. The Bidder to whom the contract is awarded will be required to meet certain insurance requirements, including but not limited to, the furnishing of public liability and workmen's compensation insurance, as well as, being required to furnish performance, statutory and maintenance bonds. The cost of said insurance and bonds is to be contemplated and included in the prices provided in the bid. The required performance, statutory and maintenance bonds to be provided shall be in the amount of one-hundred percent (100%) of the contract price. Surety companies executing the bid bonds and the performance, statutory and maintenance bonds to be provided by the successful low Bidder as part of executing the contract for the project, must appear on the most current list of the United State's Treasury Department and be authorized to transact business in the State where the project is located. Bidders agree to commence work within ten (10) calendar days after the date of a Notice to Proceed work order has been issued by the construction manager, and to complete the same as follows: _225__ calendar days. As a part of the bid on this project, the successful Bidder will be required to meet all requirements of the Underground Facilities Damage Prevention Act when engaged in work within the public right-of-way, in the same manner as if working within the private right-of-way. The successful Bidder will also be required to obtain a Sandy Soil Permit in connection with the project and shall be responsible for all fees and cost associated therewith. The successful Bidder will also be required to obtain from the Osage Nation Tax Commission, a License to do business with the Osage Nation in connection with the project and shall be responsible for all fees and cost associated therewith. The Choice of Law Affidavit, the Business Relationships Affidavit, the Non-Collusion Affidavit (Bid), the Non-Discrimination Affidavit, the Anti-Kickback Affidavit, the Site Visit Affidavit, the Bid and the Bid Bond, must be submitted by the Bidder for the bid to be considered responsive. All bids and required affidavits, certificates, and bonds must be signed and shall be tendered to the OWNER in order for the bid to be considered complete. Under Osage Nation law, the selected respondent is required to consent to the laws of the Osage Nation and the venue of the Osage Nation Trial Court for any disputes arising under the contract. The application of Osage Nation law and venue are nonnegotiable except under limited circumstances. If proposer intends to negotiate the application of the Nation's law and venue, proposer is required to state such intent and notify the Nation of the reasons thereof within the response. Whether a respondent intends to negotiate such requirements will be strictly considered in the Nation's review of the responses. Respondent is hereby notified that any waiver of the Nation's sovereign immunity is subject to review by the Principal Chief and must be approved by the Osage Nation Congress, which will cause due delay in the contract process.
