This bid security shall be a guarantee that the Bidder shall, within the time frame required in the Project Documents, enter into the contract to perform the Project. The successful bidder and all of its subcontractors of all tiers shall register with the Department of Industrial Relations (DIR) as a contractor that is working on a public works project and shall pay all workers on all work on the Project not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the DIR, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the District, pursuant to sections 1770 et seq No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a) in which circumstance the contractor or subcontractor is ineligible to respond to a bid or to do public work]. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015).
