The Contractor shall provide parking lot upgrade, modification, and slurry seal services for the EDD facility located at 629 12th Street, Modesto, CA 95354. This Agreement is entered into by and between the Employment Development Department, hereinafter referred to as the EDD, and TBD, hereinafter referred to as the Contractor, for the purpose of providing Parking Lot Upgrade, Modification, and Slurry Seal Services for the EDD facility located at 629 12th Street, Modesto, CA 95354, in accordance with IFB No. 100070. SCOPE OF WORK The intent of this Agreement is for the Contractor to provide parking lot repairs, slurry seal, signage, striping and stenciling, wheel stop replacements, demolition of existing concrete, installation of (4) concrete ramps, sidewalk, curbs, and truncated domes, etc., in accordance with the following: 1. The Contractor shall repair, slurry seal, resurface, restripe, and upgrade the entire parking lot per current California Building Code chapter 11B codes according to the specifications in the EDD Architect's plans (Attachment A-2, Parking Lot Plans). It is the Contractor's responsibility to take note of the EDD Architect's requirements and specifications. 2. The Contractor must follow the EDD Architect's specific notes and requirements. Any issues or changes regarding the plan must be preapproved by the EDD Architect. The EDD Architect will inspect and sign-off on the project after construction is complete. 3. The Contractor shall furnish and install all new components per the manufacturer's and attached Specifications, as well as accepted industry standards. 4. All work shall conform to the 2019 edition of the California Building Code and to all federal, state, and local laws and regulations, including any requirements by private agencies having jurisdiction over the work. The Contractor shall be responsible for ensuring that any item, material, or device provided or installed in the work is in full compliance with the above. 5. The Contractor shall repair the parking lot per these Specifications and Attachment A-2, Parking Lot Plans, which include Sheet Numbers "T1.1" and "A1.1 through A1.4," which are hereby incorporated as a part of this Agreement. 6. Attachment A-2, Parking Lot Plans, do not stand alone and shall be read in their entirety. It is the Contractor's sole responsibility to ensure that all requirements are included in the construction costs. 7. No changes, modifications, or substitutions shall be made to the premises, or Attachment A-2, Parking Lot Plans, as shown except with the prior written approval of the EDD Representative. If there is any discrepancy between these Specifications, and Attachment A-2, Parking Lot Plans, descriptions of the discrepancies shall be brought to the immediate attention of the EDD Representative for clarification prior to proceeding with that portion of the work. 8. The Contractor will review the EDD Architect's plans for all specifications and requirements of the work to be performed, and conform to all measurements, angles, units, lettering, etc. 9. Parking lot details: a. Approximate spaces = one hundred twenty (120) (not including crosshatches) b. Six (6) ADA parking spaces. c. Three (3) Electric Vehicle Charging Stations spaces. d. Accessible parking stall access aisles shall be striped as indicated on the approved drawings and details. e. Pavement directional arrows shall be located at the entrances and in the parking lot as indicated on the plans. 10. It shall be the responsibility of the Contractor to plan with the EDD Representative to have the parking areas and driveways cleared so that the work can be performed. Barriers shall be provided by the Contractor for all entrances and exits to the work area while the work is in progress and until drying of the entire parking lot is complete. 11. The Contractor will dispose of and haul away all related trash and debris from the site. The Contractor will be expected to provide any or all of the following during the term of this Agreement: Inspections pertaining to parking lot work/repair orders. Consultation/planning on best method to achieve the intended result. Completion of work/repair orders as provided by the EDD Representative. Identify and report to the EDD Representative any safety hazard, faulty equipment, or other condition encountered during the course of the work at the EDD office which the Contractor determines needing repair or replacement. The Contractor shall comply with all state, EDD, and local office policies and procedures while on the premises. All work shall be completed in compliance with any related drawings and specifications, and shall comply with all applicable building codes, regulations and ordinances. For final acceptance, all work areas shall be complete and ready for occupancy; all equipment shall be installed, connected and in operating condition, and all utility connections shall be complete and accepted by the city, county, or state authority having jurisdiction. The Contractor must have a valid A or C-12 State Contractor's License. Licenses shall be furnished by the Contractor in accordance with applicable local ordinances and state and federal laws regarding labor on public buildings and specifications contained in this Agreement. Should any specification in the Agreement fail to comply with such ordinances and laws, the Contractor shall be required to comply with such statutes at no extra cost to the EDD. Travel time will be at the Contractor's expense. All employees shall be paid prevailing wage. For further information you may contact Mignon Foster Schreuder at (916) 296-0070. The EDD reserves the right to reject any or all bids. Disabled Veteran Business Enterprise Participation and Incentive requirements are waived for this IFB. Term: May 1, 2024 through September 30, 2024 The EDD reserves the right to reject any or all bids and may waive any immaterial deviation or defect in the bid. The EDD's waiver of any immaterial deviation or defect shall in no way modify the solicitation documents or excuse the bidder from full compliance with the solicitation specification if awarded the contract. The EDD is not required to award an agreement. Failure to read these instructions, the Specifications, and the Terms and Conditions included in this bid package will be at the bidder's risk. Written instruction(s) regarding the submission of bids shall take precedence over any verbal instruction(s). Bidders shall complete, sign, and return all of the following documents listed below: The exterior of your envelope must clearly be noted: "INVITATION FOR BID, DO NOT OPEN IN MAIL ROOM, IFB NO. 100070." Bids will be considered "late" and will be returned to sender. A SB/MB and SB/NVSA Certification Preferences are applicable to the award of this contract. Certified SB/MB and SB/NVSAs may claim preference when submitting a bid on this Contract. The preference is equal to five percent (5%) of the lowest responsible bid. When the lowest responsible bid is not submitted by a certified small business, the preference becomes applicable. Please note that the preference is used for computation purposes only (to a maximum amount of $50,000) in determining the successful bidder. It does not alter the amount of the resulting contract. Rejection of Bids a. If the bid is received after the exact time and date as stipulated in the bid package, the bid shall be rejected. b. If it is found that a bidder is not responsible (i.e., has not paid taxes; has no business license; has submitted a bid when the bidder's license is suspended on the date of the bid opening and/or award of the Contract, or during the proposed term of the Agreement; submitted a bid without an authorized signature; falsified any information in the proposal package or has provided poor performance on a previous contract with EDD, etc.), the bid/proposal shall be rejected. c. If it is found, upon license verification with the Contractor's State Licensing Board, that a bidder's license is suspended on the date of the bid opening and/or award of the contract, or during the proposed term of the Agreement, the proposal shall be considered nonresponsive and shall be rejected. d. The EDD reserves the right to reject any and all bids and to waive any immaterial deviation or defect in the bid. The EDD's waiver of any immaterial deviation or defect shall in no way modify the bid document or excuse the bidder from full compliance with the solicitation document specifications if awarded a Contract. The Contractor shall provide a Payment Bond to accompany contracts, STD. 807, in a sum not less than 100% of the total amount payable under the terms of this Agreement, if the Agreement exceeds $25,000. A public works contract is defined as "an agreement for the erection, construction, alteration, repair or improvement of any public structure, building, road or other public improvement of any kind."
