2024 Plain Township Paving and Road Repair Project Plain Township Paving and Road Repair Project: Application of Hot Mix 448 Asphalt, Milling and Pavement Markings, Centerline Marking, Layout of Line Placement, Concrete Curb & Gutter. In the case of corporations not chartered in Ohio, the bid shall be accompanied by a proper certificate of the Secretary of State, certifying that such corporation is authorized to do business in Ohio. Each bidder must ensure that all employees and applicants for employment are not discriminated against because of race, color, religion, sex, handicap, or national origin. All contractors and sub-contractors involved with this project will, to the extent practicable use Ohio products, materials, services, and labor in the implementation of their project. Additionally, contractor compliance with the equal employment opportunity requirements of the Ohio Administrative Code Chapter 123, the Governor s Executive Order 84-9 shall be required. Successful bidders are required to submit an affidavit or verified statement as to the non-liability or liability for personal property tax in the county in which the taxing district is located (O.R.C. 5719.041). The bidder, if his bid is accepted, shall defend any and all suits and assume any liability for the use of any patented process, device or article forming a part of the apparatus or any appliance furnished under the contract. Successful bidders are required to provide a Certificate of Insurance whereby the Trustees of Plain Township are "additionally name insured" and are "held harmless" by the activities of the Contractors. Each bid shall be accompanied by a bid guaranty form of: (1) a certified check, or cashier s check, or letter of credit, equal to 10% of the bid; or (2) a bid guaranty bond for the full amount of the bid; both form of guaranty as provided in Chapter 153 of the Ohio Revised Code and in the Project Specifications. The amount of the bid for said guaranty purposes shall include all additive alternates. All bid guarantees shall be conditioned that if the bid is accepted within sixty (60) days of the bid opening, a proper Contract shall be executed, and that upon failure or refusal to enter into said Contract within ten (10) days after receipt of notification of award, the bidder and surety on any bond shall be liable to the township in an amount not to exceed ten percent (10%) of the bid. The Engineer s estimate for this Project is contained in the Project Specifications. Ohio Revised Code Section 5575.03 prohibits the Plain Township Trustees from awarding a bid if the price is more than ten percent (10%) in excess of said estimated cost. No bidder may withdraw his Proposal for a period of sixty- (60) calendar days after date and time of receipt of bids, except as provided by State Law. The Plain Township Trustees declare that they will award the contract for this project to the lowest and best bid which may not necessarily be the lowest bid. The specifications contain the Best Bid Criteria that was passed by Resolution #10-725 on October 12th, 2010 designed to gather information that may be considered in this regard. No single factor will control the Board s decision to award, and the Board reserves the right to exercise its full discretion. Prices must be firm, and any price surcharges must be included at time of bid. All work done pursuant to these specifications shall be subject to the prevailing wage rates established by the Ohio Department of Commerce-Division of Industrial Compliance, Bureau of Wage and Hour Administration. The amounts of profiling, resurfacing with Hot Mix 448 Asphalt, and other incidental materials are estimated, and the Plain Township Board of Trustees reserves the right to unilaterally increase or decrease the amounts. The Plain Township Board of Trustees reserves the right to reject any or all bids, and/or waives informality in any bid, and to accept any bid or combination of bids which deemed most favorable to the Township at the time and under the conditions stipulated.
